Box 302101 Montgomery, Alabama 36130-2101 Dear Ms. Holloway: This is in response to the information you provided this Office on January 23, 2004. Specifically, you faxed us a memorandum dated April 22, 2003 from Donald E. Williamson, M.D., State Health Officer, Alabama Department of Public Health (DPH), that was addressed to superintendents and head masters. In the memorandum, Dr. Williamson noted that concerns had been raised regarding the "sharing information with the [DPH] regarding immunizations." Dr. Williamson went on to state that the Health Insurance Portability and Accountability Act of 1996 (HIPAA) applies to students' immunization records and that HIPAA permits schools to disclose these records to the DPH. February 26, 2004 -Committee on Health, Education, Labor, & Pensions United States Senate in Regard to "Higher Education Accreditation: How Can the System Better Ensure Quality and Accountability?” Chairman Gregg, Members of the Committee, Ladies and Gentlemen: Based on my years of experience in the field, and also from my service on the National Advisory Committee on Institutional Quality and Integrity for six years, I can point to example after example where the current system has resulted in significant improvement of quality on campuses throughout the country. The system that exists whereby: (1) an institution studies itself as measured against democratically developed quality criteria; (2) the institution then is visited by a team of peers from other institutions who write a report; (3) that report is critiqued by another group; and (4) finally, advice is given to the institution as to where improvements need to be made, results on most occasions in significant improvement to the academic programs and institutions in question. For example, I know of one institution that had a number of overseas and distance learning programs that had developed rather quickly. That institution received over 100 recommendations for improvement from its accreditor. These recommendations were taken seriously, and when the next accreditation visit occurred a decade later, the institution had greatly improved its quality and received less than ten recommendations following the reaffirmation of accreditation process. Frequently, accrediting teams that visit institutions are viewed and serve as unpaid consultants to suggest best practices to help improve the institution or program.

Until recently, educational language policy in the US has been the chief site of contention about language, as seen in recent initiatives, referenda, and state constitutional amendments. Provision for drivers' licensing testing in languages other than English (LotE), on the other hand, has often exemplified what I call expedient language policy, i.e. using a LotE for a higher end, that of ensuring highway safety and enhancing opportunities (freedom of travel, especially for economic benefits, i.e. work). In some states, however, notably an Alabama case Alexander v. Sandoval, , language policy of vehicle licensing has become symbolic of other issues, and the ACLU is now pitted against the National Review, the ACLU, the English-Only and English-First organizations, as well as disability- rights organizations, many of whom have provided amicus curae briefs, all of which seems at first glance out of proportion to the importance of the issue at hand. Between the time this paper was proposed and the present, the the Supreme Court has heard this case and found in favor of the state of Alabama and against the parties to the original suit.
