Box 302101 Montgomery, Alabama 36130-2101 Dear Ms. Holloway: This is in response to the information you provided this Office on January 23, 2004. Specifically, you faxed us a memorandum dated April 22, 2003 from Donald E. Williamson, M.D., State Health Officer, Alabama Department of Public Health (DPH), that was addressed to superintendents and head masters. In the memorandum, Dr. Williamson noted that concerns had been raised regarding the "sharing information with the [DPH] regarding immunizations." Dr. Williamson went on to state that the Health Insurance Portability and Accountability Act of 1996 (HIPAA) applies to students' immunization records and that HIPAA permits schools to disclose these records to the DPH. He also stated:

U.S. Department of Justice INTRODUCTION
I'm here on behalf of the United States Department of Justice to talk about a statewide special education agreement that the United States, private plaintiffs and the State Department of Education in Alabama entered into this year that addressed issues of overrepresentation of African Americans in the mentally retarded and emotionally conflicted exceptionalities and of underrepresentation of African Americans in the learning disabled and gifted exceptionalities. I. Background A. Originally, the Lee v. Macon case began in 1963 with suit against one school board by parents and children who were seeking an injunction to prevent the Macon County School Board from continuing to run segregated schools. The case was expanded in the next few years to include the Alabama State Board of Education and over 100 local school systems. At present, 82 school systems are still under court order in the Lee v. Macon cases. In 1997, Judge Myron Thompson, in the Middle District of Alabama, called up 12 of these cases against local school districts, stating that the parties should move toward unitary status. During 1997 and 1998, the parties engaged in discovery and negotiated consent decrees with what was first 12, and then was reduced to 11, local school districts. While the state was one of the defendants in each of the consent decrees, these decrees addressed local level problems.

The town of Ashville is one of two County Seats in St. Clair County and has a population that exceeds 1,700. Located just off of I-59, 40 miles north of Birmingham and 25 miles south of Gadsden, it is a convenient drive into both of these cities. A new courthouse has recently been built and the St. Clair County Board of Education is also located in Ashville. The library is located in the center of town. The John Looney Pioneer Homestead has been a tourist attraction for years. Message from the Governor Home Contact Us Message from the Director Homeland Security Training The Office for Domestic Preparedness provides tailored training to enhance the capacity of states and local jurisdictions to prevent, deter, and respond safely and effectively to incidents of terrorism involving weapons of mass destruction (WMD). Specifically, ODP training is designed to meet the varying needs of its first responder training audiences. This includes reaching multiple disciplines, through training at the awareness, performance and planning/management levels, and employing the most appropriate mediums and vehicles for the particular audience. The Office for Domestic Preparedness General Training programs are tailored for a broad spectrum of emergency responders. However, ODP ’s Homeland Security Preparedness Technical Assistance (TA) Program provides direct assistance to State and local jurisdictions to improve their ability to prevent, respond to, and recover from threats or acts of terrorism. The Center for Domestic Preparedness, U.S. Department of Homeland Security, is charged with training emergency responders: law enforcement, firefighters, emergency medical personnel and others to deal with a terrorist attack involving Weapons of Mass Destruction and incidents involving hazardous materials.
