Revised 9/1/82 CERTAIN LAWS AND STATE BOARD RESOLUTIONS THAT PERTAIN TO PRIVATE SCHOOLS IN ALABAMA (Excerpts from Code of Alabama 1975 to 1982) . Private schools to register and report. All private schools or institutions of any kind having a school in connection therewith, except church schools as defined in Section 16-28-1, shall register annually on or before October 10 with the department of education and shall report on uniform blanks furnished by the state superintendent of education, giving such statistics as relate to the number of pupils, the number of instructors, enrollment, attendance, course of study, length of term, cost of tuition, funds, value of property and the general condition of the school. Section 1. The Commission on Public Education Assessment, Organization, and Allocation is established. The commission shall be composed of the following members:

It would make the maximum fines $60,000 for a Class A felony; $30,000 for a Class B felony; $15,000 for a Class C felony; $1,500 for a Class C misdemeanor; $3,000 for a Class B misdemeanor; $6,000 for a Class A misdemeanor; and $600 for a violation. If passed, this bill would make the maximum fine for first offense possession of marijuana for personal use $6,000. The maximum fine for the second offense or possession of marijuana that is not for personal use would be $15,000.

The Alabama Professional Education Personnel Evaluation Program (PEPE) addresses the resolution adopted by the State Board of Education in July, 1988 establishing policies and procedures requiring the development of a professional education personnel evaluation system in each local school system. However, in the event that any local board of education does not develop such an evaluation system, it is required to use the evaluation system developed by the State Department of Education. The research-based criteria used in the evaluation of professional education personnel were developed by a task force who represented superintendents; supervisors; elementary, middle, and secondary principals and teachers; business/industry; parents; school boards; higher education; specialty areas; and professional organizations and associations.

Post Office Box 1033 Alamo, CA 94505-7033 Re: Corporal Punishment Dear Mr. Riak: Dr. Richardson requested that I respond to your letter dated August 14, 1997, concerning corporal punishment in public schools in the state of Alabama. Ala. Code §§ 16-28A-1 through -5 (1975), requires each local board of education to develop a written policy on student discipline and behavior. Pursuant to this statute all teachers and administrators in each classroom are expected to maintain order and discipline and are thereby given the authority and responsibility to use appropriate means of discipline, up to and including corporal punishment, consistent with local board of education written policies. Ala. Code § 16-1-24.1 (1975) requires local boards to adopt and make available to all teachers, school personnel, students, and parents/guardians, at the beginning of the school year, a code of student conduct developed in consultation with teachers, school personnel, students, and parents/guardians. The code shall include, but not be limited to, specific grounds for disciplinary action and procedures to be followed for acts requiring discipline. Consistent with these state laws, corporal punishment should only be administered in compliance with a written discipline policy adopted by a local board of education.
