Reports Articles Reports The United Nations Development Programme Human Development Report (September, 2005)
In the chapter on Inequality and Human Development (see Chapter 2) the report takes a critical stance on the state of healthcare in the United States, exploring inequality and health in the nation. The references to the US highlight the links between healthcare and the inequalities caused by income, health insurance coverage, race, ethnicity, geography and –most importantly— access to care. The section of the report devoted to the US centers mainly on non-elderly Americans, as the focus is on the uninsured population. Importantly, the report notes the racial and ethnic health disparities existing in the US. Omitted from the report were the proposed cuts to Medicaid that will affect the welfare and health of the poor and elderly. The report refers to the differences in life expectancy between the poor and the wealthy in the US. Men in the top 5% of the income distribution enjoy a life span 25% longer than those in the bottom 5%.
The chapter on the State of Human Development (see Chapter 1) includes an in-depth exploration of changes and current trends in global life expectancy. There are still wide gaps in life expectancy between the rich and poor, linked to past setbacks, including HIV/AIDS.

Age Discrimination FAQ
Protect yourself against an employer who discriminates against you because of your age.
What's Below:

My employer has just cut the workforce in half, singling out older workers who have higher salaries. Is there any legal protection for us?
Possibly. The federal Age Discrimination in Employment Act (ADEA) provides that workers over the age of 40 cannot be arbitrarily discriminated against because of age in any employment decision. Perhaps the single most important rule under the ADEA is that no worker can be forced to retire. Under the ADEA, there has to be a valid reason not related to age for all employment decisions, especially lay-offs. Examples of valid reasons would be poor job performance by the employee or an employer's economic trouble. If lay-offs have been announced or are in the wind, talk with other affected workers. If most people who are laid off are 40 or older, and the majority of workers kept on are younger, you may have the basis for an ADEA complaint or lawsuit. This is especially likely if the employer has hired younger workers to take the places of workers over 40.

Republican, Democratic agendas unveiled Republican and Democratic leaders last month unveiled their separate, and very different, agendas for the Second Session of the 106th Congress, each group hoping to produce results that will help them win on election day in November. House Speaker J. Dennis Hastert (R-Ill.) said the Republicans will start with legislation focused on tax, trade and technology issues. Democratic leaders and White House officials led off their list with school construction, and stressed unfinished business that includes patients' rights and gun safety legislation. Republican Agenda Hastert announced that the first major House vote of the session, which began Jan. 24, will be on the first of three tax proposals: a bill to provide relief from the marriage tax penalty, under which some married couples pay more taxes than they would if they were single. That measure will be followed by a proposal to expand Individual Retirement Accounts to cover primary and secondary school expenses that may include tuition for private schools. The third bill would establish tax breaks and incentives for developing low-income communities. Senate Majority Leader Trent Lott (R-Miss.) said that Senate Republicans will focus on preserving Social Security, improving education, implementing tax cuts, rebuilding the military, and fighting the war on drugs. The first Senate vote is expected to be on bankruptcy reform legislation pending from last year.

WORKPLACE ACCOMMODATIONS POLICY HIGHLIGHTS 1.7
November/December 2003
Contents
Overview
The seventh edition of the Workplace Accommodations Policy Highlights describes recent efforts by U.S. regulatory agencies such as the Equal Employment Opportunity Commission (EEOC) and the Department of Labor (DOL) to assist employers in making accommodations for people with disabilities. The EEOC has created a fact sheet for employers, along with applicants and employees, on how the Americans with Disabilities Act (ADA) applies to employment situations involving diabetes. The EEOC also held a Public Commission Meeting on the benefits of workplace mediation, which could help settle disputes between employers and employees with disabilities. The DOL designed a seminar for employers on the development, implementation, and maintenance of emergency preparedness plans that are disability-friendly. Several judicial cases are also examined this month, including Gallegos v. Elite Model Management Corp. In this case, a state court jury in Manhattan awarded $5.2 million to a former employee, Victoria Gallegos, of Elite Model Management who sued because the company denied her the job accommodation of a smoke-free workplace. It is interesting to note that Gallegos and her attorney opted to bring charges under the New York City Human Rights Law and Smoke-Free Air Act instead of the Americans with Disabilities Act (ADA). The reason why Gallegos declined to sue under Title I of the ADA is in part due to the difficulties that plaintiffs have encountered in proving their conditions to be "disabilities" under the statute.

Age discrimination outlawed The government is consulting on draft regulations to outlaw age discrimination in employment and vocational training. In this third consultation paper on the EU Employment Directive's implementation, companies and trustees will be allowed to maintain certain age-based rules and practices for pension schemes. Age regulations will make it unlawful for trustees or pension managers to harass or discriminate against a member or prospective member of the scheme on grounds of age. Members' rights accrued before 1 October 2006 will not be affected. The regulations will exempt certain age related practices, eg:
  • closing pension schemes or parts of them to new members use of minimum and maximum ages for scheme admission, or different admission ages for different groups of employees providing different schemes to employees of different ages or with different lengths of service having a normal pension age (ie the age at which a person normally becomes entitled to receive retirement benefits) both age related and flat rate contributions into pension schemes (though the consultation document refers to “employer contributions” in this context, the draft regulations refer simply to contributions – the latter would be more helpful to DB structures that involve age related or even flat rate member contributions)

Introduction
No one doubts for a moment the difficult and complex job of human resource management in the contemporary business environment. From what I see of the business environment the challenges include:
  • international competitiveness pressures
high levels of shareholder and consumer expectations
very rapid pace of change resulting in continuous restructuring in many businesses including mergers, takeovers and downsizing
    continuous adoption of new technologies
    economic slowdown
    tax reform.

WORLD SEARCH FOR AGEING WORKFORCE SOLUTIONS
Australian Senior, November 2000 p9 Council on the Ageing Deputy Director, Veronica Sheen, has just returned from the Committee for Economic Development (CED) Ageing of the Global Workforce conference in the United States at which she was the Australian delegate. The conference was developed from the concerns about the position of older Americans in the workforce, the ageing population, and the fact that too many Americans retire before they need to or should. She looks at how Australia could learn from the American experience. Although the near full-employment situation in the United States is expanding job prospects for older Americans, they still suffer from age discrimination and other poor poor practices as do older Australians. However, it was evident that older workers in Australia are in a worse situation than older Americans. We have weaker age discrimination legislation and fewer avenues for the workforce placement, training and career counselling of mature age people.

Collecting feedback from learners (September 12) Listening to the work-based learner: unlocking the potential of learner feedback This report explains why and how to develop an effective system of collecting feedback from learners on work-based learning programmes. It argues that having an effective system of learner feedback and acting on the results, is the best proof of a learner-centred approach. Learner feedback is more than just another element in the quality assurance toolkit; it is a powerful channel for two-way communication. It can also be a medium for learning, helping to raise awareness of the contribution the learner can make to improvements in the workplace. Read this review in full... StaRS glimmer with promise (September 12) Looking back and looking forward: Strategic Area Reviews Strategic Area Reviews (StARs) have provided the opportunity for Learning and Skills Council (LSC) partners to agree priorities for their local areas. This document looks back at examples from outcomes which have been instigated through local reviews, and looks forward to further proposals to improve provision. It contains thirteen case studies which are based on different review outcomes across the country. They cover areas such as new sixth form provision, curriculum rationalisation, provision to address skills gaps, agreement of 14-19 learning entitlements, and capital investment.
