AGE DISCRIMINATION BILL TO BECOME LAW
The Attorney-General, Philip Ruddock, has heralded the passing in the Parliament of age discrimination legislation as evidence Australia is a world leader in this area of public policy. The Age Discrimination Bill 2003 passed the Senate on 15 June 2004 and will become law on receiving Royal Assent. The Bill prohibits discrimination on the basis of age in key areas of public life. These include employment; education; and access to goods, services and facilities. Mr Ruddock said the fact only three other Commonwealth Acts directed at discrimination on particular grounds have been introduced in the past three decades - the Racial Discrimination Act 1975 , the Sex Discrimination Act 1984 and the Disability Discrimination Act 1992 - was indicative of the significance of this legislation The Attorney said by enacting a broad national regime focussed on eliminating age discrimination, Australia was a world leader in this area of law and policy. It was groundbreaking legislation which delivered on a key Government commitment and was a major step towards eliminating age discrimination in Australia, he said. "The Age Discrimination Bill is a significant means of promoting a change in people?s attitudes about the contributions of younger and older people to society," he said.

Introduction
Every Australian deserves to be treated with dignity and respect. No-one should be denied the opportunity to be part of our society or our economy because of discrimination. We all have our individual contribution to make. And we all have a right to participate fully in our society. The Government has already legislated against discrimination on the basis of sex, disability and race. In keeping with our commitment at the last election we are now moving to legislate against discrimination on the basis of age.
Government Policy on Age Discrimination
The strength of any nation depends on its ability to make maximum use of the skills, resources and talents of its people. The vigour of our economy and the diversity of our society relies on making the most of the potential that exists across the population.

The Law
The Equal Employment Opportunity Commission was created by Title VII of the Civil Rights Act of 1964, but its mission has been shaped by more than this one single piece of legislation. Numerous laws and amendments, and a handful of executive orders, have expanded, limited or directed the Commission's responsibilities and authority. Some of the most significant are collected here. For historical reasons, these are presented as originally passed by Congress or issued by the President. Many, but not necessarily all, of the subsequent amendments are also gathered here. For the current texts of the laws we enforce, as amended, please see Laws Enforced by the EEOC The Supreme Court The various laws that govern EEOC's actions are subject to interpretation by the federal court system, and most importantly by the Supreme Court. These interpretations have at times reinforced, and at other times forced change upon, EEOC's role as a law enforcement agency. Some of the most significant such cases have been collected on the following page Executive Order 8802
In June 1941, on the eve of World War II, President Franklin D. Roosevelt signs Executive Order 8802 prohibiting government contractors from engaging in employment discrimination based on race, color or national origin. This order is the first presidential action ever taken to prevent employment discrimination by private employers holding government contracts. The Executive Order applies to all defense contractors, but contains no enforcement authority. President Roosevelt signs the Executive Order primarily to ensure that there are no strikes or demonstrations disrupting the manufacture of military supplies as the country prepares for War.

(CHECK AGAINST DELIVERY) Preparing to meet the new demands of healthier and longer lives is a challenge that has perhaps never been higher in the public consciousness. For those who would otherwise be below the Guarantee element, our best estimate is that take-up rates are running at over 80%. And for single women in this group, take-up could be as high as 90%. Delivering this change has only been possible because of the hard work on the ground by the Local Service working in partnership with those in the local community. In some cases, improving take-up can make a huge difference. For example, a member of the Local Service in Norwich visited an 85-year-old lady who lived alone in her home to help her complete a Pension Credit application. Because of a visual impairment she was in receipt of Attendance Allowance and had wrongly believed that this would count as income and prevent her being entitled to any Pension Credit. I believe that we are starting to change what it means to be old in our society.

The case, to be reviewed in the fall, could open up companies to many more lawsuits from middle-aged workers, in their 40s or 50s. Justices were asked to define the bounds of a federal law that protects people over age 40 from being discriminated against based on their age. The 1967 law covers about 70 million workers, nearly half the work force.

Justices will take up an appeal from police officers in Mississippi’s capital city to decide if older employees have rights similar to those of minorities when it comes to discrimination claims.
