Summary The Immigration Reform and Control Act of 1986 (IRCA) was passed to control unauthorized immigration to the United States. Employer sanctions, increased appropriations for enforcement, and amnesty provisions of IRCA am the main ways of accomplishing its objective. The employer sanctions provision designates penalties for employers who hire aliens not authorized to work in the United States. Under the amnesty provision, illegal aliens who lived continuously in the United States since before January 1, 1982, could have applied to the Immigration and Naturalization Service (INS) for legal resident status by May 4, 1988, the application cutoff date.   • Not everyone is covered
  • Not every law covers every situation. The person or group you believe has discriminated against you must also fit into certain categories. For example, employers with fewer than 20 employee s are not covered by the Age Discrimination in Employment Act
  • There are different time limits for when you can file complaints under federal and state laws.

United States labor law is a heterogeneous collection of state and federal laws . Federal law not only sets the standards that govern workers' rights to organize in the private sector, but overrides most state and local laws that attempt to regulate this area. Federal law also provides more limited rights for employees of the federal government. These federal laws do not, on the other hand, apply to employees of state and local governments, agricultural workers or domestic employees; any statutory protections those workers have derive from state law. The pattern is even more mixed in the area of wages and working conditions. Federal law establishes minimum wages and overtime rights for most workers in the private and public sectors; state and local laws may provide more expansive rights, Similarly, federal law provides minimum workplace safety standards, but allows the states to take over those responsibilities and to provide more stringent standards. Finally, both federal and state laws protect workers from employment discrimination. In most areas these two bodies of law overlap; as an example, federal law permits state to enact their own statutes barring discrimination on the basis of race, gender, religion, national origin and age, so long as the state law does not provide less protections than federal law would. Federal law, on the other hand, preempts most state statutes that would bar employers from discriminating against employees to prevent them from obtaining pensions or other benefits or retaliating against them for asserting those rights.

According to the federal government, hate crimes against Muslims and people of Middle Eastern ethnicity in 2001 increased by 1,600 percent over the previous year. The FBI's Uniform Crime Reporting Program released its annual Hate Crimes Statistics report on November 25, 2002. The report documents 481 hate crimes against Arabs and Muslims in the United States during 2001, a massive increase from the 28 cases reported in 2000. Reports from other groups, including the American Arab Anti-Discrimination Committee, the Council on American-Islamic Relations, and Human Rights Watch confirm the severity of the backlash suffered by Arabs and Muslims in the United States after September 11. Incidents included employment discrimination, airport profiling, verbal harassment, vandalism, physical assaults and at least three murders. The Department of Justice has brought federal criminal charges against a number of individuals in connection with hate crimes against Arab Americans, Muslim Americans, Sikh Americans, South-Asian Americans, and those perceived to be members of these communities. In addition, the Department's Civil Rights Division directs a National Origin Working Group which conducts outreach to affected communities and offers information about DOJ resources for victims of discrimination and abuse.

Background
In the 1960s, Americans who knew only the potential of "equal protection of the laws" expected the president, the Congress, and the courts to fulfill the promise of the 14th Amendment. In response, all three branches of the federal governmentas well as the public at largedebated a fundamental constitutional question: Does the Constitution's prohibition of denying equal protection always ban the use of racial, ethnic, or gender criteria in an attempt to bring social justice and social benefits? In 1964 Congress passed Public Law 82-352 (78 Stat. 241). The provisions of this civil rights act forbade discrimination on the basis of sex as well as race in hiring, promoting, and firing.     The government has unveiled its proposals on banning age discrimination in the workplace. What are the current rules - and why do older workers need protection? What is the current situation?
    UK workers over 65 are not protected from unfair dismissal or eligible for statutory redundancy payments. What about ageism? Ageism at work is a massive issue for many older workers. It can mean that workers in their forties are literally on the employment "scrap heap". They can not get a job, as they are considered too old by employers. While discrimination on the grounds of race, gender and disability are banned, discrimination on the grounds of age is not, under current employment law. Is there a fixed retirement age in the UK? There is no fixed state retirement age in the UK. The state pension is paid to women from 60 onwards and men from 65. This is not necessarily tied to the time that a person stops working. The Government will raise the age at which state pension is paid to women to 65, to be phased in gradually up until 2020. At work, mandatory retirement ages are fixed by an employer, which states when its employees are expected to retire.

    Age discrimination legislation: choices for the UK The United Kingdom has committed itself to legislate against age discrimination in employment for the first time, by signing up to a recent European Commission Directive. A number of other countries already have such legislation. This study looked at what can be learned from those countries' experiences and analysed the options for the UK in designing age discrimination laws. The study identified legislation against age discrimination in employment in 13 countries, and looked in detail at three (Australia, Canada and the United States) where it has been established for some time. It found:
    • Evidence of the overall effect of such legislation is in most cases weak. However:
    - Legislation has had a positive effect on employment rates of older workers in the United States. This is mostly due to them leaving jobs at a later age, rather than to more of them being hired. Employer behaviour has changed in countries with legislation, to the extent that explicit discrimination, especially in recruitment, has reduced. However, society's and employers' attitudes to older workers do not yet appear to have shifted as much as towards groups such as women and people from minority ethnic communities, where legislative protection has, generally, operated for longer.
