State and federal laws protect workers from discrimination based on their age.
Stereotypes about older people abound in our culture, but employers are not allowed to indulge in them when making workplace decisions. A number of state and federal laws prohibit employers from discriminating against employees and applicants on the basis of age.
The Age Discrimination in Employment Act
The ADEA applies to all private employers with 20 or more employees and to federal and local governments. It also applies to state governments, although their employees cannot sue them directly for age discrimination.

    Section 6101. Statement of purpose It is the purpose of this chapter to prohibit discrimination on the basis of age in programs or activities receiving Federal financial assistance. Section 6102. Prohibition of discrimination Pursuant to regulations prescribed under section 6103 of this title, and except as provided by section 6103(b) of this title and section 6103(c) of this title, no person in the United States shall, on the basis of age, be excluded from participation, in be denied the benefits of, or be subjected to discrimination under, any program or activity receiving Federal financial assistance.     The Age Discrimination Act 2004 provides an enforceable remedy in federal law for people who suffer discrimination on the basis of their age. Under the Act, the President of the Human Rights and Equal Opportunity Commission will handle complaints from people who feel they have suffered discrimination because of their age in key areas of public life.

Instead, Congress directs U.S. Labor Department to study whether separate age bias laws are needed. Congress reacts with Age Discrimination in Employment Act (ADEA). Modeled on Title VII, the ADEA, to be enforced by Labor Department, protects workers 40 to 65.     Human Rights Division
    The Human Rights Division of the Department of Labor is responsible for enforcing the North Dakota Human Rights Act (N.D.C.C. chapter 14-02.4) and the North Dakota Housing Discrimination Act (N.D.C.C. chapter 14-02.5). This responsibility includes investigating complaints alleging discriminatory practices, educating the public about human rights laws, and studying the nature and extent of discrimination in North Dakota. North Dakota human rights laws prohibit discrimination in employment, housing, public accommodations, public services, and credit transactions or lending. Discrimination means treating a person differently than another because of a particular characteristic such as race, sex, religion, or disability. In the case of disability, discrimination also means refusing to make an accommodation to allow the person with a disability equal access to the employment, housing, or service. If you feel you have been harmed by a discriminatory practice, you may initiate a complaint by completing the appropriate intake form (link to forms) and mailing or delivering it to the department. Investigative staff will assess the information you provide on the intake form to determine whether there is a basis for filing a formal complaint. If a formal complaint is filed, the department will conduct a thorough, impartial investigation into the allegations made in the complaint. The department will emphasize conciliation to resolve complaints and the parties may agree to settle a complaint at any time.
