By Topic Equal Employment Opportunity Age Discrimination The Age Discrimination Act of 1975 prohibits discrimination on the basis of age in programs and activities receiving federal financial assistance. The Act, which applies to all ages, permits the use of certain age distinctions and factors other than age that meet the Act's requirements. The Age Discrimination Act is enforced by the Civil Rights Center The Age Discrimination in Employment Act of 1967 (ADEA) protects certain applicants and employees 40 years of age and older from discrimination on the basis of age in hiring, promotion, discharge, compensation, or terms, conditions or privileges of employment. The ADEA is enforced by the Equal Employment Opportunity Commission (EEOC) Section 188 of the Workforce Investment Act of 1998 (WIA) prohibits discrimination against applicants, employees and participants in WIA Title I-financially assisted programs and activities, and programs that are part of the One-Stop system, on the ground of age. In addition, WIA prohibits discrimination on the grounds of race, color, religion, sex, national origin, disability, political affiliation or belief, and for beneficiaries only, citizenship or participation in a WIA Title I-financially assisted program or activity. Louisiana Commission on Human Rights Mission Statement The Louisiana Commission on Human Rights (LCHR) operates under the auspices of LSA 51:2231 et seq., amended and 23:301 et seq., as amended. LCHR handles complaints of employment discrimination based on race, color, religion , sex, disability, age, sickle cell trait, pregnancy, child birth and related medical conditions. Your employer must have a minimum of 20 employees to file a complaint under race, color, sex, national origin, religion and disability in employment discrimination. To file under the basis of age your employer must have 20 employees and you must be age 40 or over, sickle cell trait requires at least 20 employees and pregnancy, childbirth and related medical conditions requires more than 25 employees. The last alleged act involving discrimination must have occurred within the past 180 days. LCHR also provides protection against discrimination in public accommodations and banking and lending. Role
The American labor force has changed profoundly during the nation's evolution from an agrarian society into a modern industrial state.
The United States remained a largely agricultural nation until late in the 19th century. Unskilled workers fared poorly in the early U.S. economy, receiving as little as half the pay of skilled craftsmen, artisans, and mechanics. About 40 percent of the workers in the cities were low-wage laborers and seamstresses in clothing factories, often living in dismal circumstances. With the rise of factories, children, women, and poor immigrants were commonly employed to run machines.
The late 19th century and the 20th century brought substantial industrial growth. Many Americans left farms and small towns to work in factories, which were organized for mass production and characterized by steep hierarchy, a reliance on relatively unskilled labor, and low wages. In this environment, labor unions gradually developed clout. Eventually, they won substantial improvements in working conditions. They also changed American politics; often aligned with the Democratic Party, unions represented a key constituency for much of the social legislation enacted from the time of President Franklin D. Roosevelt's New Deal in the 1930s through the Kennedy and Johnson administrations of the 1960s.

Guidelines on Discrimination

Administrators and supervisors in the Metropolitan Government are familiar with and will comply with all laws, regulations and guidelines governing various forms of discrimination. Specific guidelines are summarized in this document. Furthermore, harassment of any person in the form of verbal or physical conduct based on a person's race, gender, color, religion, national origin or disability will not be condoned when such conduct: 1. Has the purpose or effect of creating an intimidating, hostile or offensive work environment;
2. Has the purpose or effect of unreasonably interfering with an individual's work performance; or

In October 1987, the Equal Employment Opportunity Commission (EEOC) designated the North Dakota Department of Labor as a Fair Employment Practices Agency (FEPA). A work-sharing agreement is signed annually by the North Dakota Department of Labor and the EEOC through its Denver District Office. The federal statutes include Title VII of the Civil Rights Act of 1964, as amended; the Age Discrimination in Employment Act; and the Americans with Disabilities Act. Title VII of the Civil Rights Act of 1964, as amended, prohibits employment discrimination based on race, color, religion, sex, and national origin. Sexual harassment and discrimination based on pregnancy are also covered under Title VII. The Age Discrimination in Employment Act of 1967 (ADEA) prohibits employment discrimination on the basis of age. Persons over the age of 40 are protected by the ADEA. In 1986, the age cap of 70 was revoked and today the act covers workers of all ages over 40. The Americans with Disabilities Act (ADA) was passed into law in 1990. The ADA applies to qualified individuals who have a disability, a record of a disability, or who are regarded as having a disability. In order to be protected by the ADA, an individual must show that they (1) are qualified to perform the job with or without a reasonable accommodation, and (2) have a disability. The ADA defines a disability as a physical or mental impairment that substantially limits one or more of an individual's major life functions. ADA protection applies during the hiring process, and throughout the employment relationship.
