Origin and Mandate
    During the negotiations that led to South Africa's first elections on the basis of universal suffrage in April 1994 and the transition from a minority regime to a democratically elected government, much emphasis was placed on the need for new constitutional arrangements to ensure that the appalling human rights abuses of South Africa's past could not be repeated. The interim constitution, which was adopted in December 1993 and came into force following the elections, accordingly provided for the establishment of a range of bodies to monitor government compliance with human rights standards, including a national human rights commission. Legislation was drafted once the new government of national unity led by the African National Congress (ANC) took office, and President Nelson Mandela signed the Human Rights Commission Act, No. 54 of 1994, into law on November 24, 1994. The act came into force in September 1995 and the commission held its inaugural meeting in October 1995.
Chapter 9 of the final constitution, which was drafted by the parliament elected in 1994 sitting as a constitutional assembly and came into force in February 1997, confirmed the position of the South African Human Rights Commission (SAHRC) as one of the "state institutions supporting constitutional democracy," along with the Commission on Gender Equality, the Public Protector, the Auditor-General, the Electoral Commission, the Commission for the Promotion and Protection of the Rights of Cultural, Religious and Linguistic Minorities, and the Independent Authority to Regulate Broadcasting.

SOUTH AFRICA The Bush administration has cited these and other developments to defend its decision to resist, for the present, the imposition of further sanctions against South Africa. To call for further sanctions at this time would be "inappropriate and confusing," according to Assistant Secretary of State for African Affairs Herman Cohen. However, administration officials, notably Cohen and the U.S. ambassador to South Africa, William L. Swing, have made strenuous efforts to minimize the parallels between current U. S. policy and that of the Reagan administration, which strongly resisted sanctions in favor of a policy of muted criticism and "constructive engagement." For the first time, U.S. officials have set a remarkably specific timetable for further changes. In the immediate future, Cohen told Congress in October, Washington would like to see President de Klerk release political prisoners and end bans on political organizations. By the end of the February-to-June South African parliamentary session, Washington hoped to see the abolition of such pillars of statutory apartheid as the Group Areas Act, which legislates residential segregation. If very little emerged, Cohen promised, Washington would consult Congress, U.S. allies in Europe, and Japan which at present is one of South Africa's largest trading partners about further measures. But these warnings were at the same time diluted by hints of an incremental lifting of sanctions.

Government in South Africa South Africa is a constitutional democracy with a three-tier system of government and an independent judiciary. The national, provincial and local levels of government all have legislative and executive authority in their own spheres, and are defined in the Constitution as "distinctive, interdependent and interrelated". Operating at both national and provincial levels are advisory bodies drawn from South Africa's traditional leaders. It is a stated intention in the Constitution that the country be run on a system of co-operative governance. Parliament Legislative authority is vested in Parliament, which is situated in Cape Town and consists of two houses, the National Assembly and the National Council of Provinces. The following is the text of remarks by the President of the General Assembly, His Excellency Julian R. Hunte at the commemorative meeting for 10 years of freedom in South Africa : the role of the United Nations, today, 27 April 2004
I recall, as vividly as if it were today, that momentous occasion on 27 April 1994 , when a new South Africa emerged triumphantly from the dark past of apartheid into the light of democracy and freedom.  I feel greatly honoured today to chair this special celebration, and to welcome you all, as we join the Government and people of South Africa and well-wishers the world over in commemorating ten years of democracy and freedom in South Africa
South Africa ’s significant accomplishment is also an accomplishment for the United Nations.  From the moment the organisation received the danger signal that a founding member had taken a retrograde step to institutionalize racism and racial discrimination in defiance of the Charter, ending the abhorrent system of apartheid became a matter of priority for the Organization.
For over four decades, the United Nations gave international leadership and direction to the struggle against apartheid.  Notwithstanding the different perspectives some took on this issue, the Organization shared the vision of the majority of South Africans for a country free from racism, racial discrimination, violence, despair and violation of human rights and fundamental freedoms.  It, therefore, gave moral standing to voices worldwide that demanded racial equality, economic progress and social justice for all South Africans.

Updated: July 2002 The use of the Internet has grown relatively rapidly in most urban areas in Africa, in much the same pattern as the adoption of the mobile phone which followed shortly after. As an indication, five years ago, only a handful of countries had local Internet access, now it is available in every capital city. But although these are encouraging trends, the differences between the development levels of Africa and the rest of the world are much wider in this area than they are using more traditional measures of development: Of the approximately 816 million people in Africa in 2001, it is estimated that only:
  • 1 in 4 have a radio (205m) 1 in 13 have a TV (62m) 1 in 35 have a mobile phone (24m) 1 in 40 have a fixed line (20m) 1 in 130 have a PC (5.9m) 1 in 160 use the Internet (5m) 1 in 400 have pay-TV (2m)
The Current Status of the Internet in Africa Because of the large number of shared accounts, and the high use of public access services, it is difficult to measure the total numbers of Internet users. While the number of dialup subscriber accounts is readily available, these figures are only a partial indicator of the size of the Internet sector and should be looked at along with other factors such as the quantity of international traffic each country generates and the extent of the local Internet infrastructure. The rates of growth in users seen in the 1990s has slowed in most countries as the bulk of the users who can afford a computer and telephone have already obtained connections. As of mid 2002 the number of dialup Internet subscribers was close to 1.7 million, 20% up from last year, mainly bolstered by growth in a few of the larger countries such as Egypt, South Africa, Morocco and Nigeria. Of the total subscribers, North Africa and South Africa are responsible for about 1.2 million, leaving about 500 000 for the remaining 49 Sub-Saharan African countries.

During the IMCG General Assembly in Paarl, South Africa, a total of 8 IMCG resolutions were adopted (see minutes General Assembly, elsewhere in this Newsletter). Below are the four resolutions that have not yet been published in the Newsletter. All resolutions will also be put on the IMCG website.
IMCG Resolution for Latvia
The International Mire Conservation Group (IMCG) is a worldwide organisation of mire (peatland) specialists who have a particular interest in the conservation of peatland habitats. The IMCG willingly places its advice and expertise at the disposal of any government seeking to establish or maintain mire conservation programmes. The IMCG held its 11th biennial General Assembly in Paarl, South Africa in September 2004. At that Assembly the following resolution was adopted with respect to the current provision for conservation of mires in Latvia. We appreciate the ongoing activities to protect the mires of Latvia in the face of increasing pressure for their utilization in the whole Baltic region. The 8th field symposium and General Assembly of the IMCG was held in Latvia in 1998, and we had the pleasure of visiting many Latvian mire sites. In 2003, the Mire Habitat Management Plan was prepared that provides an overview on Latvian mires, their values, and the management actions necessary for their conservation. Currently 5 projects under the European Commission financed LIFE-Nature programme include actions related to mire conservation and management. These projects include the restoration of raised bog hydrology with which Latvia can develop expertise and methodology in the restoration of raised bog ecosystems. We welcome the fact that the Ministry of Environment of Latvia supports these projects and trust that this support will continue.

SAS Helps National Treasury of South Africa Meet Hiring Goals South Africa has experienced seismic political and social change since the advent of democracy in 1994. There has been a strong desire to measure and monitor this change systematically; in particular to identify the impact of government policies, and this requirement is now being met with SAS solutions. One critical area of government policy is affirmative action on employment. Under apartheid, both government and business were dominated by the white minority. In the new era social policy has aimed to increase significantly the representation of other ethnic groups; government departments have specific demographic targets that they must meet in pursuit of this objective. The programme to ensure that South Africa's ethnic mix, people with disabilities and women are well represented in public bodies is named Vulindlela, which is the word in both Xhosa and Zulu meaning "opening the way."

INTRODUCTION
As far back as 1989, the authors of Uprooting poverty in South Africa; report of the second Carnegie inquiry into poverty and development in South Africa predicted that corruption would loom large in a new South Africa. Noting the high degree of corruption bred by apartheid, they argued that even were a democratic government to gain power, the old clerks would not necessarily learn new habits.
Their prediction was uncannily accurate. Since the transition, corruption has burgeoned in both the public and private sectors; besides violent crime, it is probably the factor which most preoccupies those who express concern about South Africa's future. Analysts have warned that corruption is the single biggest threat to the Reconstruction and Development Programme, and the establishment of a human rights culture.
This monograph, then, examines the way in which government corruption affects the poor. Because this topic spans such a vast area, only one field, social security, is examined in depth. This area was chosen because:
