    by Mark Helprin A s a junior in college in 1968 ( A.D. Though The Dehumanization of Art The Dehumanization of Art But I was shocked to discover that it was a spirited endorsement of the principles that I had expected it to condemn. In fact, it was in some ways the Gettysburg Address of Modernism: as an erudite and magnanimous capitulation of the old to the young, it seemed to the generation of 1968 to have been both wise and noble. Though first published in Spain in 1925, it had in the Sixties an air of being bravely at the forefront of changes to which only foolish reactionaries might object. Strangely enough, it has that air even today, when everything in it has been leaden orthodoxy for nearly a hundred years. In art as in politics, entrenched institutions with an affinity for survival give off the scent of revolution even as they sustain a suffocating order. Like the oxymoronic Institutionalized Revolutionary Party , which for most of this century has rigged every election and tightened every cap on every tube of toothpaste in Mexico, the conscious adherents of modernism (most are unconscious) like to think that they are revolutionaries. Art that imitates the rigor of science forgoes an infinite wealth of variables that pure nature, in its constancy and nobility, does not present, for if man is more limited in his capacities he is more interesting in his unpredictability. Art that accepts human limitations is empowered and enriched by the very discipline that the modernists ignore.

    Sunday's Times featured an op-ed by author Mark Helprin arguing that authors (and their descendents) . While Helprin has written what is by far our favorite novel of all time , we are extremely wary of his political views, which can be found frequently on the op-ed page of the Wall Street Journal , if that gives you any idea. Still, something about his argument seemed plausible, which deeply disturbed us. Knowing very little about the law, we turned to Maud Newton , who possesses the three most important qualities we look for in an expert on the subject: she is a writer, she is a former tax attorney, and she answers our e-mails. The discussion follows.
    So is Helprin's argument sound?
    No, not really. Slippery, but not sound. Not even from a legal standpoint?

    By Mark Helprin, from the April 22, 2002, issue of National Review f bin Laden is alive, he may believe that, since September 11, the United States has become more vulnerable to terrorists, to rising states, and to new coalitions that see in America's careless delusions about its powers and prospects an irresistible opening for their own. And if he did believe such a thing, he would be right, though not for the first time, as you may recall.
    It was he, after all, who watched for decades as this country was urged to strike at terrorists and the regimes that sustained them, and did not; as it was warned of Muslim religious fanatics piloting jets into its tallest buildings, and did nothing; as it suffered attacks upon its aviation, embassies, navy, and greatest city, and answered not by acts of war but in torrents of language, and gobbledygook at that. But then in a month, and with fewer casualties than on a bad weekend in Houston, we subdued a country where the Soviets could make no headway in ten years, and quickly jumped to the conclusion that we now possess a revolutionary form of military power that we can direct wherever we please. We have been told, and we accept, that as we develop this wondrous power, spending as much for defense as the rest of the world combined, we should be content that our government is responding appropriately to the attacks of September 11 and making adequate preparation in regard to dangers to come. Would that this were so. It is not.

    The War in Lebanon

    This essay will appear in the Fall 2006 issue of the Claremont Review of Books. Imagine an Israeli guerrilla organization based in the Galilee, a power unto itself, with seats in the cabinet, a generous welfare apparatus, and the oft-stated goal of Lebanon's destruction and replacement with a Jewish state governed by Jewish religious law. Upon instructions from its foreign patron and supplier of arms, it crosses the border to capture and kill some Lebanese soldiers. Lebanon, however, is in no mood to tolerate such a provocation, especially in light of the guerrillas' arsenal of 10,000 or so short-range missiles targeted at Lebanese civilians. For a month, the Lebanese air force ranges freely over all of Israel, and, without losing a single plane, cuts every major bridge and road link in the country, destroys its power plants, bombs ports, airports, military facilities associated with the guerrillas, and the guerrillas themselves, obliterating all but their buried infrastructure. Significant portions of Tel Aviv and Haifa, and many of the small towns of Israel's north, are reduced to rubble.

    Mark Helprin A Soldier of the Great War (1981) and Freddy and Fredericka is a magical realist tour de force which begins at the turn of the century in New York City, a place of steaming oyster bars, of gangs, of horses that can leap a city block, and always the sense of clear winter. Cold still nights, snow and quiet. Its a romantic fantastic tale. A Soldier of the Great War Freddy and Fredericka is the funniest of them; a British prince and princess end up in America broke and toothless (through circumstance) and end up doing more than surviving, kind of a novelistic shot at a Frank Capra story. What I love about Helprin is that more than any other writier I know, he seems able to convey optimism without weakness. Few others can write about sunshine and light the way he can. He can do darkness but you only realize when you read his prose how rare his talent is. His novels tend to be pervaded by a sense of rising toward the light. His first novel in ten years, 'Freddy and Fredericka' finds Helprin discovering in the New World and Old something his readers are least likely to expect: a farcical sense of humor that infuses his journey with laughter.     The Internets are having a spasm about writer Mark Helprin's suggestion in the New York Times that , i.e., intellectual property ought never go into the public domain. Helprin uses a rather naive comparison of intellectual property to physical property to make his argument, which is surprising since I know Helprin is smarter than that. But this is a problem with being overridingly ideological in one's political life, as Helprin is; it requires one to say and do silly things. I admire Helprin immensely as a writer, and rather somewhat less as a political thinker (although his arguments are always nicely written). I like to read his opinion pieces; I just don't agree with them very much at all. In this particular case, there are a lot of folks merrily swinging away at why Helprin has got this one completely wrong Let me give an example here. As many of you know, I've gotten offers for the movie rights to some of my books. Does this mean that the producers who are interested in the movie rights to my book want to make a movie from my book? Not necessarily. In some cases the producer in question may be trying to produce a movie similar in story/theme to my book, so in buying the rights to my book, he's getting rid of the competition (since then no one else can make a movie from my book). Yes, it's not cheap to do this (although you might be surprised), but it's a lot cheaper than having to compete with a similarly-themed movie.
