Some experts think the situation is not that series. "Chances are, few school districts will experience a computer meltdown this severe when classes resume on Monday, Jan. 3, 2000." Others predict doomsday scenarios such as the following for K-12 schools: "Administrative computer systems scramble student records. Heating and ventilation systems shut down. District-wide computer networks grind to a halt. Security doors won't open. Voice mail systems fall silent. Payroll and accounting systems print nonsense numbers – and the staff doesn't get paid." Some computer programmers have become survivalists and are stockpiling food and other supplies. Marketers are taking advantage of the millennium madness and selling survival kits, generators, blankets, oil-burning lanterns, and more. How did this problem start? "When the first computer programmers went to work in the 1950s and '60s, they took a shortcut. Instead of entering all four numbers in a year, such as 1999, they used only the last two digits: 99. That way they could save valuable space in the computer's memory. Besides, in the 1950s, the year 2000 seemed a long way off! Computer experts figured that all the programs would be different by now. They were wrong. Many of the original computer programs from the 1950s and '60s are, in fact, still in use today. In addition, many newer programs simply followed the two-digit model for tracking years."

"The plaintiff's bar is looking at Y2K with bulging eyes," Shay says. Hospitals and other health providers are at a significant risk of liability as a result of the Y2K problem, Shay says, and many will be involved in Y2K litigation due to Y2K failure. "This is a very serious problem for hospitals," he said, adding: "Most hospitals anticipate being involved in Y2K litigation." Right now, hospitals should be well on their way in testing medical equipment and information systems for Y2K readiness and contacting vendors of equipment. They also should be documenting in detail what has been tested and when. "Hospitals will need proof that they were reasonable and diligent in preparing for Y2K," in the event of a lawsuit Shay says. Four steps Shay recommends for hospitals: Access the liability risk in all its internal equipment and external vendors (including critical supplies, blood banks, pharmacy suppliers and all vendors).

Confidentiality A practice of expressly stating that e-mails are confidential may also make it easier to enforce confidentiality obligations on employees and ex-employees. In deciding whether information disclosed to an employee is implicitly confidential or within the scope of an express confidentiality provision of a contract of employment, one of the factors to be considered is whether information of the kind has been treated by the company as confidential.

We’ve all got it, the Y2K bug, and the cure is costly but not necessarily fatal in itself. It helps, as with any disease, to learn as much about it as possible, but the constant focus on the mortality rate obscures a set of positives and one major opportunity that bank directors should not overlook. Setting the Y2K problem apart from most others is that it does not distinguish between industries. Any function that is directly or indirectly dependent on computers is susceptible. Every computer-reliant organization that may have the bug in the operating system from financial institutions to telephone systems, from oil pipelines to grain elevators, from correctional facilities to auto industry production robotics has to deal with the effects of this decades old coding shortcut. This creates a level of cross-industry dependence that may be unparalleled in world history. Another unusual factor, yet common in this case to everyone, is the January 1, 2000 date certain. It is a hard deadline. No one can apply for an extension. To be sure, there are other significant dates both before and after the turn of the century (for example, many programmers are interested in how September 9, 1999, read 9999 on computers, will affect systems, if at all), but we all meet the challenge at the same time.
