Sen. Edward Kennedy says he is extremely disappointed the administration has proposed providing this relief using such a politically charged approach. The National Education Association says vouchers do nothing to solve the problems created by Hurricane Katrina. But Sen. Lamar Alexandar says it is not the start of a voucher program. The Bush administration argues the plan is fair because nearly half the students in New Orleans attended Catholic schools. Ohio may be the second state to challenge the federal government over the No Child Left Behind (NCLB) Act. Sen. Marc Dann, a Liberty Township Democrat, has introduced a resolution asking Attorney General Jim Petro to join Connecticut in suing Education Secretary Margaret Spellings. Connecticut officials claim the law is illegal because it requires states to administer tests and programs without giving them money to pay for those mandates. But Ohio may not march into court anytime soon. For the most part, state officials have embraced the law. President Bush recently honored Ohios superintendent for the states implementation of NCLB.

We at the Home School Legal Defense Association waged many of those battles in the courts, legislatures, school board hearings, and sometimes at the front door of the homeschool family. By God's grace, it is now legal to homeschool in all 50 states with minimal requirements. As homeschoolers become more comfortable with their freedom, some are wondering if they can keep homeschooling and also participate in certain public school programs. Some of these programs include public school sports teams, band, clubs, and academic classes. The short answer is: "It depends." You are probably thinking, "This is the kind of answer I expect from a lawyer!" The reason the answer is vague is because there is no fundamental right for any child to have access to the public schools in the U.S. Constitution or any state constitution. Equal access for homeschoolers to the public schools is a state-granted privilege, not a right. This means the state can give equal access to a homeschooler or take it away. The state or local public school determines the rules by which you must abide or have your privilege to participate in the public school service withdrawn. This differs from parents' fundamental right to choose to educate their own children at home. This is a right guaranteed by the First and Fourteenth Amendments of the U.S. Constitution. The right to homeschool is not a state-granted privilege.

Heather originates from Cheltenham in Gloucestershire (England) but has been living in Arizona for the past the years as a full-time student at Arizona State University. Pre-school/Nursery goes from three or four years of age and then there's Kindergarten which is like a "play school", where children begin to learn basic 3R's: reading/writing/arithmetic. When children reach the year of their fifth birthday they can begin school properly. Many parents hold their child back a year if they would be likely to be the youngest in the class. They feel it might be too demoralising for the child to be in that position. Elementary School is followed by Middle School (for 6 to 8 year olds) [I think this should read grades 6 to 8, see comment below - JC]
