Extractions: Site Index Washington, April 19 U.S. Education Secretary Margaret Spellings Monday warned Utah lawmakers that the state faces the loss of millions of dollars in federal education aid if its legislature approves a measure allowing it to opt out of No Child Left Behind Act (NCLB) provisions that conflict with state law. In a letter to U.S. Sen. Orrin Hatch, R-Utah, Spellings said that Utah could lose up to $76 million if it failed to comply with NCLB. Patti Harrington, Utah's education secretary, stressed that her office will stay "absolutely compliant" with the federal statute unless Utah law dictates otherwise. Harrington criticized the law's implementation, saying that the U.S. Department of Education (ED) was slow to issue regulations and guidance, which made it difficult to develop state plans. However, ED "wisely" has not yet forced any states to refund any money for perceived noncompliance, she added. The Utah senate is currently considering the legislation in a special session after Republican Gov. Jon Huntsman, Jr., convinced lawmakers to wait while he negotiated with the federal officials. The bill is expected to pass the senate last night, and the governor will likely sign. The state's house of representatives approved the bill earlier this year.
