The intent of the Policy of Participation and Attendance are listed below. ATTENDANCE GUIDELINES Parents are responsible to see that their children attend school, but may keep the students out of school for illness. Parents are discouraged from keeping students out of school for such things as shopping, baby tending, recreational activities, or any non-emergency family business. Students will be required to make up work assigned by the teacher in all cases of absence.

Extractions: Philip F. Marsh Following a brief literature review, this paper sets the national context, drawing on literature that focuses on the relationship between the student and the school, and where truancy/absenteeism acts to disrupt this relationship. This is followed by a brief description of the region in which the study was undertaken. The methodology for the study is then briefly outlined, followed by a discussion of the findings, particularly focusing on the relationship between the school and parents. The important finding of the study - that the key issue for schools was parent-approved absences, rather than truancy per se - is then discussed. In Australian society, education remains highly valued as the key method of attaining a successful life chance. Giddens (1990) argues that even though education has promised to reduce disparities of wealth and power by providing young people from a wide range of backgrounds with skills that will enable them to fit more easily into society, it tends on the contrary to reinforce existing inequalities rather than acting to change them. Rizvi (1993) suggests that 'poverty is not only a problem for individuals, it is also an educational issue about how relations of social distribution are arranged and how curriculum and pedagogy serve some groups better than others' (p. 45). While a line between poverty and education is clearly important, it appears trapped within a deficit theory that suggests that children who are poor lack some essential condition necessary for educational success.
Extractions: Overview of the Truancy Problem Every day, hundreds of thousands of youth are absent from school; many are absent without an excuse and deemed truant. Although national data on truancy rates are not available (in part because no uniform definition of truancy exists), many large cities report staggering rates of truancy and chronic absenteeism. In general, the proportion of truancy cases handled in juvenile court is relatively small. However, the juvenile justice system is increasingly serving as the final stop for truants and as a mechanism for intervening with chronic truants. Recent statistics available on the extent of truancy cases in juvenile court clearly demonstrate how important it is for schools and communities to confront this issue. In 1998, truancy accounted for 26 percent of all formally handled status offense cases, representing an 85-percent increase in truancy cases in juvenile court since 1989 (from 22,200 cases in 1989 to 41,000 cases in 1998) (Puzzanchera et al., forthcoming). A closer look reveals that the number of petitioned truancy cases around the country is about evenly divided between boys and girls and that whereas the majority of petitioned truancy cases involve 15-year-olds, there have been petitioned cases involving boys and girls as young as 10 (Puzzanchera et al., forthcoming).

Extractions: The California Legislature defined a truant in very precise language. In summary, it states that a student missing more than 30 minutes of instruction without an excuse three times during the school year must be classified as a truant and reported to the proper school authority. This classification and referral helps emphasize the importance of school attendance and is intended to help minimize interference with instruction. The Education Code Section that defines a truant reads as follows: Education Code Section 48260 (a): Any pupil subject to compulsory full-time education or compulsory continuation education who is absent from school without a valid excuse three full days or tardy or absent more than any 30-minute period during the school day without a valid excuse on three occasions in one school year, or any combination thereof, is a truant and shall be reported to the attendance supervisor or the superintendent of the school district. First Notification Mandate In addition to the reporting requirement, the law states that the school district must notify the parent or guardian of the truant by first-class mail or other reasonable means, and that the notification must include specific information related to the student's unexcused absences. The UMIRS page was new in Spring 2004, and many LEAs found that completing the page required a large amount of work. The UMIRS page of the ConApp requires separate data from each school site on suspensions, expulsions, and truancy. The form is generally self-explanatory, but information about the formal reporting of the data on the UMIRS page of the ConApp may be found at

The fines - similar to parking tickets - would be issued to parents of persistent truants by headteachers, police and local authority education welfare workers. In extreme circumstances first-time offenders, such as those who take their children out of school for a holiday, will be fined, the Department for Education and Skills and the Home Office said today. Half of all pupils apprehended by police in truancy sweeps of city centres are accompanied by their parents.

The minister for skills, Ivan Lewis, said new statistics showed a decrease in truancy in areas piloting the fast-track prosecution of parents of persistent truants. The figures showed that in 21 of the local education authorities operating the new system, half of parents complied when threatened with prosecution and sent their children back to school. The rest were tried in magistrates courts, where 80% of the parents were found guilty.

Extractions: Home School Legal Defense Association recently assisted a Newberry family that was charged with truancy after withdrawing their son from public school to homeschool him. The child's mother followed the public school's procedure for withdrawal of the student and received a withdrawal slip signed by the school guidance counselor. Unfortunately, due to an administrative error, the student's subsequent absences from public school were considered to be unexcused. When contacted by a school official about her son's absences, the mother furnished a copy of the withdrawal slip. However, the school attendance officer proceeded to file truancy charges in family court. HSLDA Senior Counsel Dewitt Black contacted the attendance officer by telephone, providing him with another copy of the withdrawal slip along with verification that the student was now enrolled in a homeschool association in compliance with South Carolina's compulsory attendance law. After reviewing this documentation, the attendance officer had the truancy charges dismissed.
