Instead, they may suffer from a neurobiological disorder called attention deficit hyperactivity disorder (ADHD), and they can be helped to succeed in school. In fact, the school system is legally obligated to locate and evaluate children who have this disorder, and if the children are found to be eligible, to provide special education and/or related services to meet their needs.2 Unfortunately, many teachers, administrators, and other school based professionals have had little opportunity to learn about the disorder, how to identify and treat it, or their legal responsibilities to do so. Their lack of knowledge may put children with ADHD at risk of school failure and may expose schools to lawsuits.

It is designed to help individuals of work age with disabling physical and/or mental disabilities compete successfully with others in earning a livelihood. Vocational Rehabilitation programs take an active leadership role in advocating for the rights of individuals with disabilities, removing the physical and attitudinal barriers which often confront them, and publicizing their abilities and accomplishments to society at large. In Tennessee, the Vocational Rehabilitation agency and Services for the Blind and Visually Impaired are combined as part of the Division of Rehabilitation Services (DRS) within the Department of Human Services. The Ninth Circuit has still yet to decide the issue; however, a California District Court, which is in the Ninth Circuit, has recently ruled that parents can recover damages in IDEA actions. In Goleta Union v. Ordway, 166 F.Supp.2d 1287 (C.D. Cal., 2002), the District Court held that the mother of a child transferred to high school without having his special education or behavioral needs met or his placement checked, was entitled to damages.

Humboldt Kiwanis club members journeyed down Highway 45 to the Kiwanis Center for Child Development in Jackson for their meeting last Thursday. As part of the meeting, club members enjoyed a sack lunch before touring the center. Director Ron Kwasigroh of the Jackson facility along with Education Coordinator Beth Collins gave a brief presentation of the day-to-day operations of the center. Humboldt Kiwanis Club member Jane Dunlap, Social Service Coordinator at the Jackson facility, also gave some insight on the center's activities and answered questions from club members. The center, which opened in 1969, works with children from birth to three years old. These children have mental or physical disabilities, mostly from genetic or birth defects, according to Kwasigroh. The center also operates satellite offices in Selmer, Brownsville and Lexington. "The percentage of children with disabilities is small compared to the number of adults," Kwasigroh said during his presentation. "This makes it hard to acquire funding."
