Ferguson adopted a principle first propounded in litigation attacking racial segregation in the schools of Boston, Massachusetts. Plessy concerned not schools but a state law requiring the furnishing of ''equal but separate'' facilities for rail transportation and requiring the separation of ''white and colored'' passengers. ''The object of the [Fourteenth] [A]mendment was undoubtedly to enforce the absolute equality of the two races before the law, but in the nature of things it could not have been intended to abolish distinctions based upon color, or to enforce social, as distinguished from political, equality, or a commingling of the two races upon terms unsatisfactory to either. Laws permitting, and even requiring their separation in places where they are liable to be brought into contact do not necessarily imply the inferiority of either race to the other, and have been generally, if not universally, recognized as within the competency of the state legislatures in exercise of their police power.''

Extractions: AT THE SCENE Little did we know when we were creating the Ed Psych newsletter, that we would need an interior design editor, but since the newsletter IS entitled Ed Ps tings, we feel compelled to describe some new views, with editorial commentary. Some of you noticed large sample books of fabric swatches lying about in the 880 area of Ed. Sci. At other times members of the staff could be seen pouring over paint samples, deep in serious discussion. Consensus is often extremely hard to reach, but add budget constraints to an already long list of considerations, and the challenge of designing a new look for heavily used and long unaltered areas of the 8th floor becomes awesome! Ed Psychs current Chair, Brad Brown, threw down the gauntlet before Sharon Brown and said something like, "Go forth and fix up this hell-hole!"
