The legislature took no action during the review period to require revision of the Guidelines, but the United States Supreme Court decided one case that clarifies the standard to be applied in considering the effect of temporary development moratoria under the Takings Clause of the Fifth Amendment to the United States Constitution. In Tahoe-Sierra Preservation Council, Inc. v. Tahoe Regional Planning Agency , 122 S. Ct.1465, 1478 (2002), the Court held that temporary development moratoria are not per se takings of property under the Takings Clause, reasoning that "the answer to the abstract question whether a temporary moratorium effects a taking is neither 'yes, always' nor 'no, never'; the answer depends upon the particular circumstances of the case." The Guidelines do not presently address temporary development moratoria. Accordingly, the Guidelines are revised with the addition of a new subsection 1.43(c) as follows:
