Extractions: return Recent articles in the Clarion-Ledger have pointed out the alarming increase in prison population and the long-term consequences of such policies. Here is the JP's view on this, together with a table of winners and losers. You might be surprised by who wins and who loses. Read the article Almost two million adults will greet the new millennium in American prisons. According to the Justice Policy Institute in Washington, D.C., there are six times as many Americans behind bars as are imprisoned in the 12 countries that make up the entire European Union, even though those countries have 100 million more citizens than the United States. If all these people, mostly American citizens, actually belong behind bars, then we can truthfully conclude that the American experiment with democracy has failed, that it has produced instead of a law-abiding populace a large criminal class that threatens the remaining population and must be kept in check by long-term incarceration. This is a damnable lie. We have been sold that lie by media, the giant corporations which own them, and the politicians who are in their service; a lie intended to arouse within us an irrational fear for our personal safety sufficient to still our better judgment and to accept measures which are clearly not in our best interest.

Extractions: Brian Wiersema ** I. INTRODUCTION Restrictions on carrying concealed weapons are among the most common gun control policies. [1] These statutes limit who may have a deadly weapon usually a handgunhidden on their person when outside the home. By reducing access to guns in public, concealed weapons laws seek to make firearms less available for violence. [2] Details of concealed weapons laws vary greatly among localities, but most approaches fall into two categories. One of these is a discretionary system, sometimes called "may issue" licensing. [3] Under this policy, legal authorities grant licenses only to those citizens who can establish a compelling need for carrying a gun. The other approach is a non-discretionary, or "shall issue," system. [4] Here the authorities must provide a license to any applicant who meets specified criteria. Because legal officials are often unwilling to allow concealed weapons, adopting a shall issue policy usually increases the number of persons with permits to carry guns. [5]

Code Ann. §§ 41-29-501 to -537: It is generally a violation of Mississippi law to intercept and acquire the contents of wire, oral or other communications with a mechanical or electronic device. The law against interception of communications applies neither to a "subscriber" to a telephone who "intercepts a communication on a telephone to which he subscribes," nor to members of the subscriber's household. Miss. Code Ann. § 41-29-535, Wright v. Stanley , 700 So.2d 274 (Miss. 1997) (state law prohibition on wiretapping did not apply to former wife who intercepted communications on her own telephone). Violations can be punished as misdemeanors carrying the potential for imprisonment for up to one year and fines of up to $10,000. Miss. Code Ann. § 41-29-533. It is a felony, however, for anyone who is not a law-enforcement officer to disclose the contents of intercepted communications for any reason other than testifying under oath in a governmental or court proceeding, and the penalty for such disclosure can be up to five years imprisonment and up to $10,000 in fines. Miss. Code Ann. §§ 41-29-511, 529. Civil liability for an unlawful interception is expressly authorized for actual damages, $100 a day for each day of violation or $1,000 whichever is greater along with punitive damages, attorney fees and litigation costs. Miss. Code Ann. § 41-29-529. In addition, the law specifically provides that if a person is a party to a communication, or has obtained consent from any one of the parties, no civil liability can be imposed unless the interception was accompanied by a criminal or tortious intent. Miss. Code Ann. § 41-29-531. According to current legislation, the laws in place regarding the interception of wire and oral communications are set to be repealed on July 1, 2004. Miss. Extractions: Mississippi Black Code Adapted from a document placed online by Jud Sage at Northern Virginia Community College The status of the Negro was the focal problem of Reconstruction. Slavery had been abolished by the Thirteenth Amendment, but the white people of the South were determined to keep the Negro in his place, socially, politically, and economically. This was done by means of the notorious "Black Codes," passed by several of the state legislatures. Northerners regarded these codes as a revival of slavery in disguise. The first such body of statutes, and probably the harshest, was passed in Mississippi in November 1865. Four of the statutes that made up the code are reprinted below. Biographical Statements of Experts Assessing the Draft Law Appendix A Draft Law on the Organization of the Judiciary Appendix B Analysis of the Draft Law on the Organization of the Judiciary for the Republic of Armenia I. Introduction An important feature of the Concept Paper on Judicial Reforms for the Republic of Armenia was the papers focus on judicial independence: true independence from the executive branch. The draft Law on the Organization of the Judiciary of the Republic of Armenia, however, seems to focus on structure more than substance. It may be that additional laws will be passed to codify the lofty statements of the concept paper. If not, then this draft law falls short of the strong statement necessary to establish true independence of the judiciary. Overall, the law is well conceived. However, the law may contain too much administrative detail concerning the day-to-day job responsibilities of judges and, in contrast, provide insufficiently clear definitions of the powers of the courts. The constitutional independence of the courts from the executive branch of the government needs to be more clearly stated as a general principle.

Law Of The United States - Wikipedia, The Free Encyclopedia In the arena of criminal law, states have somewhat similar laws in regards to to Apart from model codes, the American law Institute has also created http://en.wikipedia.org/wiki/Law_of_the_United_States
Extractions: The law of the United States is derived from the common law of the United Kingdom , which was in force at the time of the Revolutionary War . However, the supreme law of the land in the United States is the United States Constitution and, per the Constitution, treaties to which the U.S. is a party. These form the basis for federal laws under the federal constitution in the United States, circumscribing the boundaries of the jurisdiction of federal law and the laws in the fifty U.S. states and territories. edit Although the U.S. and most Commonwealth nations are heirs to the common law legal tradition, American law tends to be unique in many ways. This is because the American legal system was severed from the British system by the Revolution, and afterwards, it evolved independently from the British Commonwealth legal systems. Therefore, when attempting to trace the development of traditional judge-made common law principles (that is, the few that have not already been overridden by newer laws), American courts will look at British cases only up to the early 19th century. Although the courts of the various Commonwealth nations are often influenced by each other's rulings, American courts rarely follow post-Revolution Commonwealth rulings unless there is no American ruling on point, the facts and law at issue are nearly identical, and the reasoning is strongly persuasive. The earliest American cases, even after the Revolution, often did cite contemporary British cases, but such citations gradually disappeared during the first half of the 19th century as American courts developed their own homegrown principles to resolve the legal problems of the American people. Today, the vast majority of American legal citations are to domestic cases. Sometimes, courts (and
