Extractions: Legal Defense of Cyclists' Rights There are two general areas of action: criminal defense, and judicial relief. Cyclists frequently should receive much better defenses than they receive. When I reviewed the only book of nationwide judicial opinions about bicycle law, Paul Hill's Bicycle Law and Practice, I discovered that in almost all of the cases nobody in the courtroom knew what they were considering. Not the judges, nor the attorneys for either side, nor the witnesses when testifying to bicycle matters. Some appeals opinions were contrary to man's law, others were contrary to physical law. Many were incredible. That book (1986) disclosed, to my eyes at least, the shoddy state of the practice of law as it pertains to cyclists. If BTI decides to intervene in any case, that intervention must be performed in the very best manner, lest all the effort go down the drain or, even worse, turn out to our disadvantage. Another situation involves laws that are invalid. For example, California does not allow local authorities to enact traffic laws, except where specifically provided for. Several California cities have enacted local ordinances that prohibit cycling on particular streets, or on the roadways of particular streets. The cyclist who gets prosecuted for using such a street is not violating any law, because those ordinances are invalid. However, the first that the cycling community learns about such laws is when a cyclist is prosecuted. Then, the defense must be that that ordinance is invalidated by state law. Even when learning such, some communities keep such ordinances on the books, probably to frighten children with. Others recognize the law and repeal them.

Extractions: Issue 7 - August 2001 As reported in the June 2001 issue of JLIB News, good progress had been made with the electronic capture of all Jersey legislation in force. We are now able to report that at the end of July 2001, a copy of the final version of the database containing the legislation was delivered to the Law Draftsman's Office for final checking and acceptance. As soon as this stage of the project has been completed it is hoped to allow public access to the legislation in force through the JLIB website. A complete index of the data, designed in a user-friendly manner, will accompany the database to allow users to find relevant legislation. The index has been structured to enable users to see details of each law and all amending and subordinate legislation under one index entry. Although the data capture project represents a huge step forwards it is, as stated in earlier newsletters, merely the first step in the law revision programme. Discussions are now underway to progress to the next stage, which will be to begin the official revision and consolidation of all Jersey legislation. It is hoped to appoint an expert to undertake that work in the coming months, with a view to completing the ambitious project within 2 to 3 years.

As Congress recognized in establishing this Commission, it is vitally important that China make progress on human rights. This is important first and foremost for Chinese themselves, who have long lived under political systems that denied them fundamental freedoms and are now navigating a difficult transition toward a market economy and, hopefully, a more open society. But it is also important for the rest of the world. China's emergence as a global power is one of the most important geopolitical events of our lifetimes. It is essential that the China that emerges from this process is one that respects individual liberties and its internationally binding commitments on human rights. Progress on human rights in China is also vital to the United States. Our relationship with China is one of our most important bilateral relationships. It cannot be truly cooperative until the human rights situation in China improves. These new laws contain serious flaws in conception and face many obstacles in implementation. Reformers within China are working to highlight these problems and to press for further change. In the meantime, Chinese themselves are making increasing use their expanded legal system. The number of cases in the Chinese courts, including successful suits against the state, has risen dramatically in the last decade. In addition, new groups have emerged to advocate for improved legal protection of rights, often through legal aid centers for women's rights or administrative litigation or the environment. As this shows, legal reform and other developments in China are creating increased rights consciousness and higher expectations for the legal system. This is a very important trend, for law should not only foster respect for human rights. It should also be a means by which individuals can demand respect for human rights.
