Its purpose is to represent the medical profession in the courts, in accordance with AMA policies. Specialty societies may and do request assistance from the Litigation Center. The AMA and those state medical associations who wish to be members of the Litigation Center must pay annual dues. An Executive Committee of ten members governs the Litigation Center. Eight of these members are representatives of state medical associations. One of the members is an AMA employee, and the final member is an AMA trustee. The Litigation Center director is an experienced trial attorney. In 2004, all 50 state medical associations, plus the Medical Society of the District of Columbia and the AMA, are members of the Litigation Center. Cases are selected under an established case selection protocol, according to a variety of criteria, including their importance to the medical profession and their precedential value. Since its inception in 1995, the Litigation Center has become involved with more than 100 cases representing the interests of physicians and patients, ranging from administrative proceedings to cases before the United States Supreme Court. The issue in this case concerns the circumstances under which a court can require a physician to testify as an expert witness, against the physician's wishes. In this case, the plaintiffs contended, and the trial and lower level appellate courts held, "compelling circumstances" justified such compulsory testimony. Those compelling circumstances were the negligent failure by the plaintiffs' attorney to secure the services of a willing expert witness within the time allowed by the trial court's scheduling order. Dr. Michael Plante was an obstetrician/gynecologist for Sinora Glenn. He provided her with certain medical services, including a hysterectomy. Following the hysterectomy, Mrs. Glenn went to a new physician, Dr. Charles H. Koh. Mrs. Glenn and her husband, Christopher Glenn, sued Dr. Plante for medical malpractice. Dr. Koh wrote a letter to the court on the Glenns' behalf, stating that Dr. Plante's medical procedures, including the hysterectomy, had been inappropriate and unwarranted. In that same letter, though, he stated that he did not want to testify in court against another physician. Subsequently, he wrote another letter, this time to the Glenns' attorney, indicating that Mrs. Glenn's treatments had been "unusual and may not meet the standard of care." The second letter reiterated that he "would not be an expert witness."

The problem includes the perception of a harassing backlash against psychologists who have been involved in interpersonal violence cases and issues. In particular, some psychologists who work with child or elder maltreatment, spousal / partner battering, and adults who recall memories of childhood abuse have been targets or personal and organized harassment. The forms of harassment have included personal threats and picketing of offices, media campaigns, as well as ethic and licensing board complaints and lawsuits. Psychologists who find themselves subjected to a nuisance or unsubstantiated grievance may experience vulnerability, loneliness, PTSD symptoms, or professional and financial consequences. They often experience isolation and secondary traumatization. Our committee was particularly concerned with various organized efforts developed to help alleged perpetrators of interpersonal violence and others pursue board actions, ethics complaints and nuisance lawsuits against psychologists who have served as therapist, forensic evaluator, expert witness, or client advocate for victims of interpersonal violence. As a witness, you must tell the truth. A witness who knowingly does not tell the truth is subject to criminal prosecution. The lawyer calling you as a witness or other lawyers involved in the case may talk about the case with you before the trial. It is the lawyer's job to try to find out what you know about the case and explain courtroom procedures to you. However, you do not have to talk to the lawyer before the trial if you do not want to. In some lawsuits, one of the parties may want your testimony under oath before trial. The taking and recording of a testimony before the actual trial is called a deposition, usually conducted in the office of one of the lawyers. A word-for-word transcript is made of the deposition. A deposition helps each party in the lawsuit prepare his or her case. In some cases, the evidence in the deposition encourages the parties to settle the lawsuit before the trial.
