Extractions: BAYPORT LAND USE ISSUES Peter H. Brown, AIA, AICP September 15, 1999 This is the first report of a Bayport Land Use Study commissioned by Galveston Bay Conservation and Preservation Association that is to examine the impacts that the proposed Bayport Container Terminal will have on the Clear Lake area and surrounding communities. GBCPA is continuing to raise money for this study. Land Use Issues Industrial uses are generally classified in municipal land use regulations based on two categories: light industry and heavy industry. Light industry includes warehousing, and manufacturing involving the assemblage of pre-manufactured parts, such as computers or small machines and products. Heavy industry includes manufacturing involving chemical processes and significant noise, airborne particulate matter and glare. Transportation terminals, railroads, ports, airports, electric generating stations, substations, utility plants, breweries, smelters and chemical plants are classified as heavy industry. Industrial uses generally account for 3%-5% gross (or 6%-8% net) of the land use of a city or sub-region, and tend to be concentrated in large agglomerations, close to major transportation arteries (highways, freeways, inter-coastal waterways, ports and railroads). There are three reasons for the concentration of heavy industrial uses.

Year-round enjoyment for members of all ages is provided through the many boating and non-boating activities sponsored by the Club. It is also recognized as a special place for social and business entertaining. In addition to an excellent full service dining room, the Club has a well respected instructional sailing program for people of all ages. Its naturally protected harbor affords convenient access to deep water and is just minutes from local fishing, sailing, swimming, and rendezvous locations. Questions regarding membership and club activities may be directed to the Membership Chairperson or Club General Manager and a personal tour may be arranged. Inter-club races and wild game dinners were the main social features of the club around 1935-36. The boats were of various types and sizes which, although making racing difficult, was by no means sufficient reason to prevent this activity. In 1936, Commodore Burdeno presented the club with a perpetual sailing trophy awarded annually to the catboat winning the July 4 th race. Another annual event the membership found they could depend on was the sinking of the houseboat when a big northeaster would blow. As with racing, teamwork continued to build with all member coming out to help raise and clean her so that life could continue.

Recreational Uses Canoeing, Kayaking and Sailing View this map In 1997 Statistics Canada conducted a survey in nature-related activities on the Importance of Nature to Canadians. The map combines the data for these three boat types, classed by major river basins. It shows that the amount of usage across Canada is closely correlated to population, but also that usage is distributed throughout most of Canada. The use of non-mechanized watercraft on freshwater is as old as the Canada's first inhabitants. The canoe and kayak, in particular, were developed by Aboriginal Canadians as their transport vehicles. Canoes played an exceptionally large role in the exploration of Canada: Europeans quickly adopted them for exploration and for the long-distance transport of furs. Sailboats (as used for recreational purposes) were largely introduced by Europeans to Canada and have had a much more recent history here. Today, all three types of vessels are widely used for recreational purposes by Canadians. The data on usage shown on the map, and in the figure below comes from a major survey conducted in 1997. In that year, Statistics Canada conducted a survey on behalf of a nationwide partnership of 16 federal, provincial and territorial agencies interested in nature-related activities. The

Information on trends in participation documents the demand for recreation opportunities and can be useful in planning for recreational facilities. Why Can't This Entire Indicator Be Reported at This Time? Data on national recreation participation have been collected since 1960, but earlier surveys are not compatible with the most recent, and most thorough, survey. Data from 1995 are available for the activities shown in the figure (see the core national recreation indicator ). With the exception of freshwater fishing, these data do not distinguish what portion of the activities took place in fresh water rather than salt water. In 1995, Americans spent a total of 886 million days fishing in fresh water. The second National Survey on Recreation and the Environment is under way, but it is not clear if it will provide all of the data needed for this indicator. Extractions: January 8, 2002 Summary of Opinion Plaintiff Hardy was injured while hiking on Forest Service land that was managed by defendant corporation under a permit from the Department of Agriculture. Defendant claimed immunity under the New Hampshire recreational use statute and the trial court granted summary judgment in its favor for that reason. Text of Opinion Appellant Kathleen Hardy fell on a path at the top of Loon Mountain, breaking her leg. She claims that appellee Loon Mountain Recreation Corporation ("Loon Mountain" or "Loon") was responsible for her injury. The district court concluded that a New Hampshire recreational use statute immunized appellee from liability and thus granted summary judgment for the company. We affirm. I. Background Loon Mountain operates a recreational area on United States Forest Service land in Lincoln, New Hampshire, under a special use permit that gives the company a nonexclusive right to offer recreational programs at the site. Loon's mainstay during the winter months is its operation of a ski area. In the summer, its activities include a gondola ride to the top of the mountain. The mountain peak houses sightseeing activities, a snack bar, and hiking paths. Under the terms of the Forest Service permit, visitors may hike and sightsee in the area without paying a fee. On August 2, 1998, appellant visited Loon Mountain with several companions. After entering the gondola house at the bottom of the mountain and reading information about the varied activities at the top, each member of appellant's group paid five dollars to ride Loon's gondola to the top of the mountain. Once they arrived at their destination, they saw a sign directing visitors to various activities. Loon did not charge admission fees for any of the activities offered at the mountain's crest. Appellant visited the snack bar and the glacial caves, and saw a live presentation by "the Mountain Man" (who regaled the visitors with tales of "folklore, legend, and local history"). Appellant accessed Loon's various activities on paths, bridges and wooden stairways constructed and maintained by Loon. Appellant fell and suffered her injuries on the way back to the gondola.
