The judicial branch of the United States government is made of up the federal court system and several supporting agencies. The U.S. Supreme Court was established by the Constitution ( U.S.Const. art. III, § 1 ). The lower federal courts were created by Congress. Case law is primary law created by judges in the course of resolving disputes. It is the written resolution of the issues, written by a judge or a panel of judges. It is not a jury verdict. Juries decide facts; judges decide law. The word case is often used interchangeably with opinion or decision. Not all opinions are published. Opinions with precedential value are published in sets of books called reporters. Unpublished opinions can sometimes be found online. Precedents are the legal principles or rules created by court opinions. Lower courts must apply these precedents in cases with similar issues and facts. This system allows similarly situated people to be treated the same.

In addition, Congress has established 13 federal courts of appeals and 95 federal district courts. The president has the authority to appoint federal judges as vacancies occur, including justices of the Supreme Court. The Supreme Court meets in Washington, D.C., and the other federal courts are located in cities throughout the United States. The federal courts hear cases arising out of the Constitution, federal laws and treaties and maritime cases; cases involving foreign citizens or governments; and cases, in which the federal government is itself a party. With minor exceptions, cases come to the Supreme Court on appeal from lower courts. The State has had four constitutions, each containing a declaration of rights - the State's bill of rights. Maryland's first constitution was adopted during the Revolutionary War in 1776, the second in 1851, and the third in 1864. The fourth and present constitution was adopted in 1867. The Supreme Court was created by Article III of the Constitution and is the highest court in the land. The Supreme Court is headed by the Chief Justice of the United States. The Chief Justice and the other eight associate justices who hear and decide cases are appointed by the President and confirmed by a two-thirds vote of the Senate. In most cases, the Court has discretion to decide whether or not to accept a case for review. Only a small number of the thousands of appeals filed with the Supreme Court each year are accepted for review. When the Court decides a case, the justices issue a decision known as an "opinion". The Chief Justice of the United States is William H. Rehnquist. Justice Rehnquist was orginally appointed to the court as an Associate Justice by President Richard Nixon in 1972. In 1986, Justice Rehnquist was appointed Chief Justice by President Reagan after Chief Justice Warren Burger retired. Bibliography All delegates at the Constitutional Convention agreed on the need for a federal supreme court, but were divided almost equally on the need for a federal court system in addition to existing state courts. Some delegates thought state courts could handle trials and the Supreme Court any appeals relevant to the federal government. They feared the encroachment of federal courts on the state court jurisdictions. Others feared the cost of maintaining a federal court system. When the Constitution was written Article III established the framework for the third branch of government, the judiciary. According to the Constitution, "the judicial Power of the United States, shall be vested in one supreme Court, and in such inferior courts as the Congress may time to time ordain and establish." Other than the mandate for a Supreme Court, the U.S. Constitution left the formation of other federal courts up to Congress to decide at a future date. The Judiciary Act of 1789 established the country's first federal court system. The establishment of the federal courts alongside state courts was a unique arrangement in judicial history; no other country had established such a dual system. The basic organization of the federal court system has not changed substantially over the years. The federal judiciary consists of three layers. At the bottom are the United States District or trial courts, in the middle are the appellate courts, and at the top the United States Supreme Court. In addition, there are special courts established by Congress to deal with specific types of cases, such as duties and tariffs, claims against the government, taxes, bankruptcy, patents, and military justice. Congress has also empowered certain executive branch and agencies with quasi-judicial authority; all of which are subject to review by the Supreme Court of the United States. (See
