The 120-member Knesset has the power to dissolve the Government and mandate elections. The current Knesset and Prime Minister Ariel Sharon were elected democratically in 2003. (An annex to this report covers human rights in the occupied territories. This report deals only with the situation in Israel itself.) The judiciary is independent and often ruled against the Executive, even in security cases. During the year, a total of 76 Israeli civilians and four foreigners were killed as a result of Palestinian terrorist attacks in Israel and the occupied territories, and 41 members of the Israeli Defense Forces were killed in clashes with Palestinian militants. During the same period, more than 800 Palestinians were killed during Israeli military operations in the occupied territories. Internal security is the responsibility of the Israel Security Agency (ISA or Shin Bet), which is under the authority of the Prime Minister. The National Police, which includes the Border Police and the Immigration Police, are under the Minister of Internal Security and the Minister of Interior respectively. The Israel Defense Forces (IDF) are under the authority of a civilian Minister of Defense. The IDF includes a significant portion of the adult population on active duty or reserve status. The Foreign Affairs and Defense Committee in the Knesset oversees the IDF and the ISA. Security forces were under effective government control. Some members of the security forces committed serious abuses.

There was no change in the status of respect for religious freedom during the period covered by this report. The Basic Law describes Israel as a "Jewish and democratic state." The overwhelming majority of non-Jewish citizens are Muslims, Druze, and Christians and generally are referred to as Israeli Arabs. Israeli Arabs are subject to various forms of discrimination, some of which have religious dimensions. Israeli Arabs and other non-Jewish Israelis, are, in fact, generally free to practice their religions. Relations between religious groupsbetween Jews and non-Jews, between Muslims and Christians, and between the different streams of Judaismoften are strained. Societal tensions between Jews and non-Jews exist primarily as a result of the Arab-Israeli conflict; such tensions increased significantly during the period covered by this report. The U.S. Government discusses religious freedom issues with the Government in the context of its overall dialog and policy of promoting human rights.

Israeli reaction so far has been to impose further restriction on the detainees and psychologically torture them. Prison officials have also deprived the protesters of any water and salt, making the hunger strike extremely dangerous and potentially fatal. We will ward off this strike, and it will be as if it never happened," according to Haaretz, an Israeli newspaper. Amnesty International, among other human rights groups, have long reported a history of violent abuse toward Palestinians incarcerated in Israeli jails. Records show incidents of blindfolding, tight handcuffing, prolonged kneeling and squatting, prohibition from using the toilet, severe beatings, and being confined to small, cold, coffin-like cells.

In 1948 it was decided to adopt a written constitution, and a Constituent Assembly was elected to implement this decision. However, internal political problems soon led to a decision to postpone the immediate adoption of a constitution. Instead, the constitution would be prepared by the Knesset, Israels parliament, chapter by chapter in a series of "Basic Laws" which would eventually be brought together to form the constitution. Thus the Basic Laws, taken together, comprise a "constitution-in-the-making." At present, the drafts of three additional basic laws are being circulated prior to their submission to the Ministerial Committee on Legislation: Draft Basic Law: Due Process Rights; Draft Basic Law: Social Rights; and Draft Basic Law: Freedom of Expression and Association. Most chapters of Israel's prospective constitution have already been written and enacted as Basic Laws . They outline the basic features of government: the President, the Knesset (Israel's legislature), the Government, the Judicature, the Israel Defense Forces, and the State Comptroller. In 1992, two new Basic Laws were added: Freedom of Occupation; and Human Dignity and Liberty. These were the first Basic Laws which explicitly protected human rights.

    Extractions: In April 2003, Rabbi Arik Ascherman, Executive Director of the Rabbis for Human Rights, together with Ori Omer, and Shai Eliezer Tzvi found themselves between a bulldozer and a home destined for demolition. Despite their non violent protest, the homes were destroyed, leaving two large extended families homeless within minutes. The three were arrested and charged with interfering with police in the execution of their duties. On March 22, 2005, The Court concluded that the trial proved that the Defendants actions interfered with a police officer in the fulfillment of his duties, and that the actions were done with the intention to interfere with a police officer in the fulfillment of his duties. The Court rejected all of the arguments that the Defense presented before the court, and found Rabbi Ascherman guilty of 2 counts of criminal behavior, and Mr. Omer guilty of 1 count, according to Chapter 275 of the Israel Penal Code (1977), which includes a sentence of three years in jail or a fine.
