Extractions: Patents are probably the most widespread form of IP in biotechnology and are set up by governments to encourage innovation. In return for public disclosure of innovations and developments through publication of a patent, the government grants the patentee the right to exclude others from practicing these innovations for a specific period of time. It is hoped that these inventions will provide the basis for further innovations, improve the economic position of the country and ultimately increase the standard of living. Patents therefore can have implications for every person regardless of their age, knowledge of IP and social status. Patents provide valuable economic and social benefits to both researchers and the general public alike. Some of the benefits are detailed below: By developing or purchasing IP and licensing it amongst the market place, market share is decentralized, and as a result the technology is much more widely accessible by all. By licensing amongst a large number of corporations and researchers, the chance of further inventions and improvements are increased due to the large amount of researchers with access to the technology and the diversity of skills that exist amongst an increasingly wide range of innovators. By increasing the size of its IP portfolio, an institution enhances its value, not only in a monetary sense by licensing the IP to others, but also its market share. The institution may capitalize on its IP portfolio to command a higher price in merger or acquisition negotiations or to raise capital to fund further research. Take-over bids are sometimes initiated by companies wanting access to an institution's IP. IP portfolios can therefore also be used as bargaining chips in negotiations. Recently companies have been known to pay exorbitant fees to access the rights to a particular technology if they are aware that they may be able to bring an infringement case against a 3rd party who is known to be making unauthorized use of the IP.

Extractions: Browse Patent Applications: Prev Next USPTO Class 710 The subject invention relates to a Universal Graphics Adapter (UGA) that is a hardware-independent design that encapsulates and abstracts low-level graphics hardware in a standard manner through firmware. UGA is a firmware standard, intended to wrap existing or planned hardware, including VGA. UGA does not require the use of real-mode assembly language, direct hardware register, or frame buffer access to program, thus providing advantages over conventional systems. UGA supports basic drawing operations, continuous display modes, and power management. As a firmware-based standard, UGA facilitates updating a system to support both evolving and new hardware features.

Extractions: Monday, July 19, 1999 Extending software patent protection In State Street, Signature secured a patent on a system that implements an investment structure in which mutual funds (the "spokes") combine their assets into a single investment portfolio (the "hub") that is organized as a partnership. This structure allows investors to receive investment benefits coupled with partnership tax advantages. 149 F.3d at 1370. The system provides for a daily allocation of assets for spokes invested in the same hub. The system allocates among the spokes the hub's daily income, expenses and gains or losses. The system also determines aggregate year-end values. Given the complexity of the calculations that must be quickly and accurately performed, a computer "is a virtual necessity." Id. at 1371. State Street brought a declaratory judgment action and moved for summary judgment, alleging that the patent was directed to unpatentable subject matter under 35 U.S.C. 101. The district court granted the motion. On appeal, the Federal Circuit reversed, holding that: (1) the claims, which contained "means-plus-function" language subject to 35 U.S.C. 112, 6, were directed to a machine (proper subject matter under § 101); and (2) "mathematical algorithms are not patentable subject matter to the extent that they are merely abstract ideas... constituting disembodied concepts or truths that are not useful." However, "the transformation of data, representing discrete dollar amounts, by machine through a series of mathematical calculations into a final share price, constitutes a practical application of a mathematical algorithm, formula, or calculation, because it produces a useful, concrete and tangible result." 149 F.3d at 1372-73.

Continuing higher education review Brown and Weiner (1985) define environmental scanning as a kind of radar to scan the world systematically and signal the new, the unexpected, the major and the minor (p. ix). Aguilar (1967) has defined scanning as the systematic collection of external information in order to (1) lessen the randomness of information flowing into the organization and (2) provide early warnings for managers of changing external conditions. More specifically, Coates (1985) has identified the objectives of an environmental scanning system as: detecting scientific, technical, economic, social, and political interactions and other elements important to the organization defining the potential threats, opportunities, or potential changes for the organization implied by those events
