Extractions: Illinois Law Update Prepared by students of the University of Illinois College of Law CASES ILLINOIS SUPREME COURT State may rely solely on pictures as evidence depicting child pornography People v Normand No. 97984, 2005 WL 1341279 (Ill Sup Ct 2005) On June 3, 2005, the Illinois Supreme Court affirmed the decisions of the Illinois Appellate Court, Second District, and the Circuit Court of Ogle County, sentencing the defendant to two years of probation on several counts of possession of child pornography. On appeal in the supreme court, the defendant argued that the lower courts relied on a statutory definition of "child" later declared unconstitutional, and that the evidence in the case was insufficient to convict him. In an earlier decision, the supreme court held unconstitutional language in the child pornography statute which states that a person could be convicted of possessing child pornography if the individual depicted in the allegedly illegal picture appeared to be a child. As to the defendant's first argument, the court rejected it, concluding that the trial court did not rely on the definition of "child" that was later found unconstitutional. Because the trial court determined that the children depicted in the pictures were actual children, the Illinois Supreme Court affirmed the trial court's decision on this point.

The law prohibits discrimination based on sexual orientation in employment, housing, public accommodations and credit. Although the law reaches much further than federal civil rights legislation, Illinois is not necessarily unique. There are 13 other U.S. states, in addition to the District of Columbia, that have non-discrimination laws protecting homosexuals (and transexuals). What makes Illinois unique is that unlike most municipal prohibitions on sexual orientation discrimination, Illinois does not expressly exempt religious organizations from their coverage. What does this mean, practically speaking? The bill may very well compel religious organizations to set aside convictions about homosexuality when hiring clergy and other staff. No matter where you find yourself on homosexual civil rights, it seems reasonable to expect that religious organizations (and indeed homosexual groups) should have the freedom to choose who they want to lead them, and who they wish to associate with. The bill will be challenged in court and its fate remains uncertain, but so too does the fate of religious freedom in Illinois.
