Known variously as "private voluntary organizations," "civil society organizations," and "citizen associations," they are increasingly called “NGOs,” an acronym that stands for "non-governmental organizations." The United Nations system uses this term to distinguish representatives of these agencies from those of governments. While many NGOs dislike the term, it has come into wide use, because the UN system is the main focus of international rule-making and policy formulation in the fields where most NGOs operate. Charitable and community organizations, separate from the state, have existed in many historical settings, but NGOs are primarily a modern phenomenon. With the extension of citizenship rights in Europe and the Americas in the eighteenth and nineteenth centuries, people founded increasing numbers of these organizations, as instruments to meet community needs, defend interests or promote new policies. The French writer Alexis de Toqueville emphasized the importance of what he called “political associations” as institutions of democracy, uniquely numerous and influential in the United States at the time of his famous visit in 1831. New legal rules for private corporations, emerging at this same time, provided modern juridical authority for the organizations and increased their defenses against state interference.

    Extractions: Site Index Amanda Davies addressed a number of items that required follow up from the September Forum. A request had been made for the establishment of guidelines to determine the effectiveness of costs orders when human rights cases come before the Federal Court. It was noted that no specific action had yet been taken, however the Department and the Court would be maintaining an ongoing dialogue on costs orders and a review of the operation of costs orders regime would occur within three years. Ms Davies outlined the fee structure for the Federal Court for human rights matters. This is a $50.00 filing fee only which can be waived in appropriate circumstances such as hardship. The Department indicated that it welcomed any views on what information should be obtained over the period for an effective review. A request had also been made for the removal of Australia's reservation to article 37(c) to the Convention on the Rights of the Child (CROC). Ms Davies outlined that Australia has made a reservation to the second sentence of Article 37(c) which provides that children deprived of their liberty are to be separated from adults unless it is in the best interests of the child not to do so, and that children have the right to have contact with their family through visits. It was explained that the housing of juveniles in detention was primarily a matter for States and Territories and that there were occasions when adults and children were imprisoned together because of Australia's demographic distribution to enable young offenders to remain near their families. The Department indicated that the reservation would be unlikely to be withdrawn unless compliance with the article was possible.

    Extractions: Issue 3 The Czech Government and NGOs in 2001 Petr Pajas, First Consulting, p.b.c., Praha The aim of this presentation is to provide a short overview of recent decisions and actions taken by the Government of the Czech Republic with respect to the financing of activities of civil organizations. This includes: (a) revival of the full operational activity of the Council for Non-governmental Not-for-profit Organizations (b) distribution of privatization assets to active foundations, (c) detailed analytic research of Government donations to the civil sector, and (d) the very recent Government Regulation on Principles of Donation Policy from the Budget of the Czech Republic to Non-governmental Not-for-profit Organizations, based on the analysis mentioned above. In November 1997, the transitory government of Mr. Tošovský replaced the Government of Mr. Klaus. This was an event marking an important turn in the Czech society from a strictly economical and highly pragmatic approach to an approach that is more sensitive to issues of a free and active civil society. In 1998, this trend brought to power the minority government of Social Democrats. After seven years of permanent disputes regarding the role of civil society and its non-political organizations in modern democracy, one may observe the politicians changing their attitudes toward the civil sector from an arrogant disinterest to recognition and cooperation.

    Extractions: Page In January 2001, following a year of preparatory work in CNNO working groups and many consultations with the Budget Committee of the Czech Parliament, the Czech Government approved Decision No. 12/2001 on the Procedure by which the Remaining Assets Set Aside for the Foundation Investment Fund shall be Distributed in the Second Stage (to Foundations). Actually, this represents an open tender, in which a special commission shall choose from registered and applying foundations those to which another portion (and probably the last one) of assets in the amount of about CZK 2,000,000,000 shall be distributed to become a part of their registered endowment and/or partially (not more the 15 percent of the contribution) directly redistributed according to current granting regulations of each foundation. The sum of allocated evaluation points shall be the main supportive evidence for the final recommendation of the plenary of the CNNO as regards the amount of assets to be allocated to a foundation or whether there shall be no allocation at all. It is assumed, that the minimal assignment should be CZK 10,000,000. In the case of too many applicants, this may limit the list of those who will be assigned a contribution. Accordingly, those foundations who did not receive enough evaluation points may not receive any funds. However, in general, this limit may support a reasonably uneven distribution among about 120 foundations. We must wait for the result of the tender to see if this is the case.

Definition and Classification of NGOs 2. The diversity of NGOs strains any simple definition or classification. The terminology varies: for example, in the United States they may be called "private voluntary organizations," and most African NGOs prefer to be called "voluntary development organizations."
