Malavet The Course: A practical application of the comparative method to the study of the law that gives the civil law system its name: the Civil Code. We will focus on black-letter rules applicable to institutions common to most civil codes in the areas of Family Law, Property, Contracts and Torts. The introduction will include a discussion of the comparative method in the context of our course, and an overview of the civil law, its historical antecedents, structure and interpretation. Students will write a paper on a topic related to our subject matter. The paper will be drafted in stages that will include several oral presentations in class. Comparative law is not a prerequisite. Text: Materials Handout. A Civil Code Supplement and reading materials will be included in this handout. Because of the large number of pages in the material, a copy charge may be required. Students must get two binders in which to keep their materials. Office Hours : I will have regular office hours on Mondays, from 2:30 to 4:30 p.m. and on Wednesdays, from 11:00 a.m. to 12:00 noon. To assist lawyers in this aspect of their practice, there are many different types of form books available. When using form books, one should keep in mind that they are all general in nature. Therefore, before using a form, extreme care should be exercised to make sure that the language is entirely suitable for the purpose for which it is to be used. Online Sources Introduction Sexual harassment law is a form of discrimination based upon the sexualized treatment of a victim. A cause of action for sexual harassment can arise in the context of federal, state, or local law. While sexual harassment claims most often occur in the area of employment law, they can also arise in other arenas. The legal principles found in employment based discrimination cases may or may not be applicable in a non-employment context, depending on the facts and jurisdiction. Thus, depending upon the basis for the sexual harassment claim, the researcher may have to consider a variety of federal and state law sources. This research guide provides the main sources of law for sexual harassment, primarily in the employment context, and guides the researcher to several good sources for sexual harassment law on the federal level, and under Florida law. No attempt is made to be comprehensive; rather, the research guide provides sources that are current, well-focused, and that provide information and good starting points for further research, including non-employment sexual harassment. Both sexual harassment sources and gender discrimination civil rights sources are given where they are helpful. In our Jan. 15 column, we learned that West Publishing Company("West") prints Texas statutory law in two arrangements: the civil statutes in Vernon's Texas Revised Civil Statutes Annotated ("civil statutes"), and the codified statutes in Vernon's Texas Codes Annotated ("Codes") [ See " Making Vernon's Volumes Work for You , " page 26]. Now let's test your legal research acumen. Question 1: What is the origin of a civil statute? Question 2: How and why is a civil statute enacted into a code? THE 1925 BULK REVISION Answer to Question 1: The 1876 Texas Constitution contains the following provision: "The first session of the Legislature under the Constitution shall provide for revising, digesting and publishing the laws civil and criminal; and a like revision, digest and publication may be made every ten years thereafter; . . . ." Since the adoption of the 1876 Constitution, Texas has had four bulk revisions of its statutes. A "bulk revision" involves major changes to the substance of the law by reenactment of all of the statutes (in contrast to those statutes on a particular subject), eliminating repealed, invalid, duplicative and other ineffective provisions. The four bulk revisions occurred in 1879, 1895, 1911 and 1925. See Joseph H. Pool, "Bulk Revision of Texas Statutes," 39 Tex. L. Rev. 469 (1961).
