And in doing so Lord Justice Mathew Thorpe said - and this is the radical bit - that the application seemed "to ignore the realities involving the different roles and functions of men and women". Pakistan is not a party to the Hague Convention, and there is no bilateral treaty in effect between the U.S. and Pakistan which would cover parental child abduction. While the courts of Pakistan may take into account the laws of other countries, custody orders from other countries are viewed simply as evidence in a Pakistani proceeding. Possession of a custody order, even in the absence of such an order by the Pakistani spouse, will not automatically result in the return of an abducted child. That parent would have to appeal to the family court in order to try to obtain an order for custody. Although appeal to the courts may seem difficult to a mother seeking custody of her children, it is recommended that parents be urged to appeal to the courts or other legal resources available. If a foreign-born mother has the only court order (U.S. or other) in effect regarding the custody of her child, it is also recommended that in addition to appealing to the courts, she should seek assistance in effecting that order from other local authorities (i.e. from local police or school officials).

In late 1996, Spruill began serving a five-year sentence in an Illinois prison for various property crimes that stemmed from drug abuse. One of her sons was placed in foster care. Another, born in prison, followed. But Spruill was determined to eventually reunite with her children, so she began rehabilitating herself, taking parenting-skills courses and undergoing substance-abuse treatment. Her efforts appeared to pay off. After two years, Spruill was released into a halfway home and she began the necessary court proceedings to get her kids back. There, however, she encountered the Adoption and Safe Families Act, a federal law passed in 1997 that requires states to move to sever a parent's right to a child after he or she has spent 15 months in foster care.

Extractions: Adoption is the legal act of permanently placing a child with a parent or parents other than the birth parents. Adoption results in the severing of the (A father or mother; one who begets or one who gives birth to or nurtures and raises a child; a relative who plays the role of guardian) parent al responsibilities and rights of the biological parents and the placing of those responsibilities and rights onto the adoptive parents. After the finalization of an adoption, there is no legal difference between biological and adopted children. Different jurisdictions have varying laws on adoption and post-adoption. Some practice confidential or closed adoption, preventing further contact between the adopted person and the biological parents, while others have varying degrees of open adoption, which may allow such contact. Many children are placed for adoption as a result of the biological parents' decision that they are unable to adequately care for a child. In some developing countries, where single parenthood may be considered scandalous and unacceptable, some women in this situation make an adoption plan for their infants. In some cases, they abandon their children at or near an orphanage, so that they can be adopted. Some biological parents involuntarily lose their parental rights (called termination of parental rights or TPR in the United States). This usually occurs when the children are placed in foster care because they were abused, neglected or abandoned. After about 15 months, if the parents cannot resolve the problems that caused or contributed to the harm caused to their children (such as alcohol or drug abuse), a court may terminate their parental rights and the children may then be adopted.
