One is president of the Birmingham Urban Mountain Pedalers who also happens to be a street bike guy and the other represents hikers and urban bicyclists. We have left distance bicycling to the Alabama Department of Transportation as they deal with statewide bicycle planning issues and have deep pockets for alternative transportation projects. The fear of a lawsuit is often enough to prevent private landowners from opening their land to mountain bicycling even though they would like to share their land with the public. Public land managers must also deal with the issue of liability and may even use it as one reason to close trails to mountain bicycling. Most states have enacted laws that greatly limit both private and public landowner liability. On the private side, these laws are called Recreational Use Statutes. For public land, the governing law is usually the state's Governmental Immunity Act or State Tort Claims Act. These laws are important for the future of mountain bicycling as they can shift the burden of responsibility to bicyclists and away from private landowners and public land managers. Private landowners and public land mangers are more likely to welcome mountain bicycling and other recreational activities if they are protected from liability. IMBA has always stressed personal responsibility for mountain bicycling and this notion can be further underscored by these laws. While most states currently have laws that limit landowner liability, these laws can vary greatly from state to state. The purpose of the following information is to provide a general picture of how these laws work and to answer some general questions regarding landowner liability. Welcome The Delaware and Hudson Rail Trail is a 19.8 mile long converted railroad bed in southwestern Vermont which was originally part of the Delaware and Hudson rail system that connected Rutland, Vermont with Albany, New York. The two nearly ten mile long sections extend through scenic areas of western Rutland and Bennington Counties with views of nearby hills, open farmland, forests, wetlands, end villages. The rail trail leaves Vermont and continues into New York State in three locations. However, these sections have not been developed for recreational purposes, the uses mentioned below may not be suitable and portions of the railbed have legally reverted to the adjacent private landowners. Trail Uses Trail Surface The trail surface consists of the original cinder ballast and in some locations gravel and stone. The trail, although graded, may offer a surface too soft for the narrow tires found on most ten- speed bicycles. The surface is better suited for the wider tires of mountain bikes.
