This work will also aid policy makers and academics in their quest for improved methods and procedures for resolving issues related to the large number of personal injury claims in such litigation. The Appellate Rules Advisory Committee has written a new Rule 32.1 which permits attorneys and courts in federal appeals in all circuits to cite unpublished opinions. At its June 2004 meeting, the Standing Committee on Rules of Practice and Procedure asked the Appellate Rules Advisory Committee to ask the Federal Judicial Center to conduct empirical research that would yield results helpful to the Standing Committee's consideration of the proposed rule. The Center's research effort consisted of three components: (1) a survey of judges, (2) a survey of attorneys, and (3) a survey of case files. This report was presented to and considered by the Standing Committee during its June 15-16, 2005 meeting, at which it approved the Advisory Committee's proposed rule for consideration by the Judicial Conference at its September 2005 meeting.

The basic conflict stems from the fact that trademark law allows for multiple uses of the same word. Two different entities may label their products with the same name, as long as the consumer is not likely to be confused or deceived as to the affiliation, connection or association of the two. Ford automobiles are not confused with Ford agency fashion models. Consumers do not call Delta Air Lines in order to purchase Delta faucets. Unfortunately, in cyberspace there is only one delta.com. This new policy imposed a mandatory dispute procedure on domain holders. Resolution services will be supplied by approved providers. Three organizations that have received provider accreditation are the World Intellectual Property Organization, The National Arbitration Forum and a small US/Canadian startup, eResolution.org. Others may be approved soon.

This competition involves the coordination of over 100 volunteer participants who serve as judges and witnesses as well as 20 teams from law schools across the country.
