Langbein [FNa] University of Chicago Law Review, Fall, 1985 Our lawyer-dominated system of civil procedure has often been criticized both for its incentives to distort evidence and for the expense and complexity of its modes of discovery and trial. [FN1] The shortcomings inhere in a system that leaves to partisans the work of gathering and producing the factual material upon which adjudication depends. We have comforted ourselves with the thought that a law-yerless system would be worse. [FN2] The excesses of American adversary justice would seem to pale by comparison with a literally nonadversarial systemone in which litigants would be remitted to faceless bureaucratic adjudicators and denied the safeguards that flow from lawyerly intermediation. The German advantage. The main theme of this article is drawn from Continental civil procedure, exemplified for me by the system that I know reasonably well, the West German. [FN3] My theme is that, by assigning judges rather than lawyers to investigate the facts, the Germans avoid the most troublesome aspects of our practice. But I shall emphasize that the familiar contrast between our adversarial procedure and the supposedly nonadversarial procedure of the Continental tradition has been grossly overdrawn.

During the past two decades, the percentage of U.S. highway fatalities that can be classified as alcohol related (i.e., those involving alcohol-positive road users, such as drivers, bicyclists, or pedestrians) has fallen from 57 to 38 percent (National Highway Traffic Safety Administration [NHTSA] 1999). The reasons for this extensive reduction in alcohol-related highway fatalities are not fully understood. It is clear, however, that this decline coincides with a significant increase in the number and severity of drunk-driving laws. Such laws serve two major functions. First, they help prevent impaired driving by the public (i.e., exert a general deterrent effect) by Increasing the perceived risk of arrest and sanctioning. Second, they reduce the likelihood of recidivism (i.e., exert a specific deterrent effect) by imposing sanctions on people who are apprehended for driving while intoxicated (DWI). This latter deterrent primarily concerns the courts, which handle DWI offenders.
Extractions: Introduction Procedural rules (also called court rules) prescribe what to do and how to do it when bringing a case before a court. These rules establish a uniform process for trying cases and ensure that justice is fairly administered throughout federal, state, and local court systems. Separate sets of procedural rules exist for each jurisdiction. Within a specific jurisdiction, different sets of rules govern different types of cases. For example, separate rules exist for civil cases, criminal cases, and juvenile cases. Other rules govern appellate cases. In addition, individual courts ( e.g ., U.S. Supreme Court) frequently have their own local procedural rules. Procedural rules are mandatory. If they are not properly followed, courts may refuse to hear a case or may impose sanctions on errant parties. Therefore, anyone involved in litigation must understand and abide by relevant rules of procedure. Fortunately, many tools exist to help litigants comply with procedural requirements as they prepare a case for court. This guide focuses on rules of civil procedure which govern in the U.S. District Court and in the Minnesota District Court, the trial courts for each jurisdiction. The guide provides information on sources which contain or comment on the Federal Rules of Civil Procedure (Fed.R.Civ.P.) and the Minnesota Rules of Civil Procedure (Minn.R.Civ.P.). Tips for finding other court rules are included.

Bush signed into law the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (the Bankruptcy Abuse Act), making sweeping changes to the United States Bankruptcy Code. The Bankruptcy Abuse Act was the culmination of more than seven years of debate over bankruptcy reform, much of which centered on reforms designed to prevent perceived abuses by consumers. Several of the changes, however, will likely have significant impact on vendors and commercial landlords whose customers or tenants file for bankruptcy protection. Included in this newsletter are summaries of three of those changes. Although certain provisions of the Bankruptcy Abuse Act took immediate effect, most changes made by the Act, including those discussed inside, become effective in bankruptcy cases which are filed on or after October 17, 2005.
