Extractions: OTHER BILLS OF INTEREST TO CCLU AN ACT REQUIRING CRIMINAL BACKGROUND CHECKS ON CAREGIVERS TO THE ELDERLY. Failed This bill was introduced by the Select Committee on Aging. This bill would have required nationwide criminal background checks on caregivers and administrators who seek and are offered work in a nursing home or home health care agency (care providers), including people hired through a temporary employment agency. Caregivers include people whose employment or contractual service with a care provider includes physical access to patients or access to patients' finances. Starting October 1, 2002, the bill would have prohibited providers from hiring such employees without a background check. The bill also would have established procedures for these background checks. It prescribed the duties of the Department of Public Safety (DPS), which conducts the checks, and the Department of Public Health (DPH) , which makes the decision to disqualify people from such employment if they are unfit for it and have been convicted, incarcerated, or on probation in the past three years for any of a list of specified crimes. The bill afforded the disqualified applicant an opportunity for a hearing and appeal. DPH would have had to keep the background check information confidential.

These cases would not have been possible without the dedicated support of attorneys who volunteer to assist CCLU. FIRST AMENDMENT Brown v. Damiani Rutchick v. Franklin (U.S. District Court): In this case, we filed a complaint on behalf of a Franklin resident who raised a sign on his property to commemorate a local Korean War veteran who was killed in action. The town issued a cease and desist order. The complaint alleges that the zoning regulation upon which the town based its cease and desist order is unconstitutional because it prohibits signs on the basis of their content. Connecticut Resources Recovery Authority v. Mitchel TOP EDUCATION REFORM (Connecticut Supreme Court & Superior Court): We returned to court this year to enforce the landmark 1996 ruling of the Connecticut Supreme Court finding school segregation in Hartford area schools unconstitutional. The compliance hearings in "Sheff 3" were held between April 16 and May 3. Plaintiffs’ witnesses included Dr. Leonard Stevens, who presented a new plan for expansion of magnet schools and interdistrict choice programs in the Hartford Region, and Dr. Gary Natriello, who analyzed the impacts of the state's limited efforts to date. Defendants’ witnesses included the state education commissioner, Theodore Sergi, and Marc Ryan, Secretary of the Office of Policy & Management. Judge Aurigemma has requested post-trial briefs, but both sides have now agreed to a three month stay of proceedings to discuss a possible interim settlement.

Relying on R.A.V. , California defendants challenged the constitutionality of California's Penal Code hate violence statutes. A subsequent United States Supreme Court decision decided in 1993, Wisconsin v. Mitchell (1993) 508 U.S. 476 [113 S.Ct. 2194, 124 L.Ed.2d 436], upheld a Wisconsin bias-motivated penalty enhancement statute as constitutional and narrowed the potential scope of the R.A.V. decision affecting hate crimes statutes. Four pre- and post- Mitchell California cases challenging California's hate crimes statutes have also been upheld by California appellate courts.
