However, by common sense death penalty was thought justified as it was mean to serve social ends for which purpose it was enacted. Furthermore, the Government is duty bound to protect the society from criminal elements who form a very small segment of the population. National leaders In the past some of our national leaders such as D. S. Senanayake, S. W. R. D. Bandaranaike and Professor Gunapala Malalasekera made sincere attempts to remove the death penalty from the statute book. In 1928 D. S. Senanayake moved a resolution in the Legislative Council to abolish death penalty but it was rejected as there was no alternative proposed. Susantha de Fonseka in 1936 introduced a proposal in the State Council for the same purpose suggesting life imprisonment as the alternative but that too failed.

First, Turow explains who served on this Commission: Two sitting prosecutors; two sitting public defenders; a former Chief Judge of the Federal District Court; a former U.S. senator; three women; four members of racial minorities; prominent Democrats and Republicans.
