Perhaps the single most important rule under the ADEA is that no worker can be forced to retire. Examples of valid reasons would be poor job performance by the employee or an employer's economic trouble. If lay-offs have been announced or are in the wind, talk with other affected workers. If most people who are laid off are 40 or older, and the majority of workers kept on are younger, you may have the basis for an ADEA complaint or lawsuit. This is especially likely if the employer has hired younger workers to take the places of workers over 40.

Extractions: November/December 2003 The seventh edition of the Workplace Accommodations Policy Highlights describes recent efforts by U.S. regulatory agencies such as the Equal Employment Opportunity Commission (EEOC) and the Department of Labor (DOL) to assist employers in making accommodations for people with disabilities. The EEOC has created a fact sheet for employers, along with applicants and employees, on how the Americans with Disabilities Act (ADA) applies to employment situations involving diabetes. The EEOC also held a Public Commission Meeting on the benefits of workplace mediation, which could help settle disputes between employers and employees with disabilities. The DOL designed a seminar for employers on the development, implementation, and maintenance of emergency preparedness plans that are disability-friendly. Several judicial cases are also examined this month, including Gallegos v. Elite Model Management Corp. In this case, a state court jury in Manhattan awarded $5.2 million to a former employee, Victoria Gallegos, of Elite Model Management who sued because the company denied her the job accommodation of a smoke-free workplace. It is interesting to note that Gallegos and her attorney opted to bring charges under the New York City Human Rights Law and Smoke-Free Air Act instead of the Americans with Disabilities Act (ADA). The reason why Gallegos declined to sue under Title I of the ADA is in part due to the difficulties that plaintiffs have encountered in proving their conditions to be "disabilities" under the statute.

In this third consultation paper on the EU Employment Directive's implementation, companies and trustees will be allowed to maintain certain age-based rules and practices for pension schemes. Age regulations will make it unlawful for trustees or pension managers to harass or discriminate against a member or prospective member of the scheme on grounds of age. Members' rights accrued before 1 October 2006 will not be affected. The regulations will exempt certain age related practices, eg: closing pension schemes or parts of them to new members use of minimum and maximum ages for scheme admission, or different admission ages for different groups of employees providing different schemes to employees of different ages or with different lengths of service having a normal pension age (ie the age at which a person normally becomes entitled to receive retirement benefits) both age related and flat rate contributions into pension schemes (though the consultation document refers to employer contributions in this context, the draft regulations refer simply to contributions the latter would be more helpful to DB structures that involve age related or even flat rate member contributions)

The conference was developed from the concerns about the position of older Americans in the workforce, the ageing population, and the fact that too many Americans retire before they need to or should. She looks at how Australia could learn from the American experience. Although the near full-employment situation in the United States is expanding job prospects for older Americans, they still suffer from age discrimination and other poor poor practices as do older Australians. However, it was evident that older workers in Australia are in a worse situation than older Americans. We have weaker age discrimination legislation and fewer avenues for the workforce placement, training and career counselling of mature age people.
