In addition, we will briefly explain some of the techniques used by unions to organize employees, and what management should and should not do to show employees that union representation is not in their best interests. In a prior booklet in this series, we explained the basic outline of the Act, the collective bargaining process, and conduct prohibited by the Act, known as "unfair labor practices."

TITLE XIII-CHILDREN'S ONLINE PRIVACY PROTECTION
SEC. 1301. SHORT TITLE.
This title may be cited as the "Children's Online Privacy Protection Act of 1998".
SEC. 1302. DEFINITIONS. In this title: (i) among the several States or with 1 or more foreign nations; (I) another such territory; or (II) any State or foreign nation; or (iii) between the District of Columbia and any State, territory, or foreign nation; but (B) does not include any nonprofit entity that would otherwise be exempt from coverage under section 5 of the Federal Trade Commission Act (15 U.S.C. 45). (A) the release of personal information collected from a child in identifiable form by an operator for any purpose, except where such information is provided to a person other than the operator who provides support for the internal operations of the website and does not disclose or use that information for any other purpose; and (i) a home page of a website;

United States House of Representatives June 11, 1997 Mr. Chairman, distinguished members of the committee: My name is Roger Pilon. I am a senior fellow at the Cato Institute and the director of Cato's Center for Constitutional Studies. I want to thank you, Mr. Chairman, for inviting me to testify before the committee on H.R. , the Civil Asset Forfeiture Reform Act of 1997. Your recent book on forfeiture, which I am pleased to have edited and the Cato Institute is proud to have published, is a refreshing call for reform. You are to be commended for having written it, for having introduced this bill, and, more generally, for having taken up the issue of forfeiture reform when so many in Congress have ignored it. That the state of our forfeiture law today is a disgrace is hardly in question. A body of "law" that enables law enforcement personnel to stop motorists and seize their cash on the spot, to seize and sometimes destroy boats, cars, homes, airplanes, and businesses in often fruitless drug searches, and even to kill and maim in the course of seizure operations is out of control. Even lawyers who come upon this area of the law for the first time are taken aback by the injustice and utter irrationality of it all. About the only people who defend forfeiture law today are those in law enforcement who benefit from it, either as a "tool of their trade" or, more directly, by keeping the goods they seizea conflict of interest so stark that it takes us to another age. In fact, that is just the problem with modern forfeiture law: in practice as well as in theory, its roots are in notions that have no place whatever in our legal system, animistic and authoritarian notions that countless people have died over the ages to bury and replace with the rule of law.

Introduction separate set of rights in addition to fair use, to display (show) and perform (show or play) others' works in the classroom apply to any work, regardless of the medium. Until recently, however, when the classroom was remote, the law's generous terms for face-to-face teaching in Section 110(1) shrank dramatically in Section 110(2) some would say to the vanishing point! The TEACH Act expands the scope of educators' rights to perform and display works and to make the copies integral to such performances and displays for digital distance education, making the rights closer to those we have in face-to-face teaching. But there is still a considerable gap between what the statute authorizes for face-to-face teaching and for distance education. For example, as indicated above, an educator may show or perform any work related to the curriculum, regardless of the medium, face-to-face in the classroom - still images, music of every kind, even movies. There are no limits and no permission required.

The RIPA allows the government to access a person's electronic communications in a very unrestricted manner, thus infringing in the privacy of their correspondance in a manner many would not tolerate regarding their postal communications. The act:

The RIPA incurs into civil liberties in several ways:
    The government can demand that a public telecommunications service intercepts an individual's communications
    The act's "interception warrants" can be served for purposes of "national security", "preventing or detecting serious crime" or "safeguarding the economic well-being of the UK". These (undefined) terms are so vague as to be applicable to just about anyone.

Section 3: Commission Rules and Enforcement.
A violation of Rules of the Public Company Accounting Oversight Board ("Board") is treated as a violation of the '34 Act, giving rise to the same penalties that may be imposed for violations of that Act. Section 101: Establishment; Board Membership.
The Board will have five financially-literate members, appointed for five-year terms. Two of the members must be or have been certified public accountants, and the remaining three must not be and cannot have been CPAs. The Chair may be held by one of the CPA members, provided that he or she has not been engaged as a practicing CPA for five years. The Board's members will serve on a full-time basis. No member may, concurrent with service on the Board, "share in any of the profits of, or receive payments from, a public accounting firm," other than "fixed continuing payments," such as retirement payments. Members of the Board are appointed by the Commission, "after consultation with" the Chairman of the Federal Reserve Board and the Secretary of the Treasury.
