Changes to Ontario's
Off-Road Vehicles Legislation/Regulations
Off-road vehicles (ORVs) now have more access to the shoulder and paved portions of some Ontario highways. These new regulations, effective July 31, 2003, apply exclusively to one category of ORV . This is defined as an off-road vehicle that:
  • has four wheels, the tires of which are all in contact with the ground; has steering handlebars; has a seat that is designed to be straddled by the driver; and meets requirements of federal Motor Vehicle Safety Act (MVSA) and American National Standards Institute (ANSI standard).
New regulations do not apply to other types of off-road vehicles such as mini-bikes, dirt bikes and moto-cross bikes.
Municipal Authority Regarding Off-Road Vehicles
As of July 2003, municipalities were given the authority to determine whether or not off-road vehicles (ORVs) should be allowed access to highways

The Maryland Department of Natural Resources provides trails for off-road vehicles, or ORV's, in Garrett, Potomac, Green Ridge, Savage River and Pocomoke State Forests. An ORV is defined as a motorized vehicle designed for or capable of cross-country travel on land, water, snow, ice, marsh, swampland or other natural terrain. Off-road vehicles include a four-wheel drive or low pressure tire vehicle; an automobile; a truck; a motorcycle and related two-wheel vehicles; an amphibious machine; a ground effect or air cushion vehicle; a snowmobile; and a golf cart. Off-road vehicles must be registered annually with DNR and display a registration sticker. Registration stickers are available from any DNR regional service center , and stickers and trail maps are available at the five state forests where ORV use is permitted. It is recommended that you call the State Forest and Park Office you will be visiting before using the trails to be advised of current trail closures or hazards. Off-road vehicles (ORVs) such as all-terrain vehicles (ATVs) and snowmobiles are increasingly popular in Manitoba. However, if not used properly, these vehicles can be extremely dangerous.
The Facts
Snowmobiles can weigh 400 to 600 pounds (180 to 270 kg) and travel at speeds in excess of 100 km/hour. In Manitoba in 1997, 11 people died as a result of snowmobile crashes and two people died in other off-road vehicle crashes. In 1997-98, 157 Manitobans were injured in snowmobile mishaps and 83 Manitobans were injured in other off-road vehicle mishaps. Three-wheeled ATVs have not been manufactured in Canada since 1987 due to extreme instability, but many are still in use. Drowning is a major cause of snowmobile-related death, especially during freeze-up and spring thaw. Excessive speed, alcohol, night driving, inexperience, and riding on highways are involved in the majority of injuries to adolescents and young adult drivers.
Protecting your family
Manitoba law prohibits children under 14 from driving an ORV unless supervised by a parent or authorized adult. Immature judgment and motor skills are often factors in ORV-related injuries to children younger than 16.

The Chattahoochee National Forest located in North Georgia, and the Oconee National Forest located in Central Georgia, are popular with individuals and family groups wanting a scenic and often challenging ride within the National Forest. Off road vehicles are defined as any motorized vehicle which travels off-road for recreational purposes. ORV's include: motorbikes such as minibikes, dirt bikes, enduros and motorcross bikes; four-wheel drive vehicles such as jeeps, land rovers, and pickups; all-terrain vehicles such as the popular three and four-wheelers; dune buggies; and snowmobiles.
ORV Rules and Regulations The Chattahoochee-Oconee National Forests operate under motor vehicle laws set by the State of Georgia. This means that anyone operating an off road vehicle on a Forest Service road (including dirt/gravel roads) must follow all State vehicle laws and must have a valid driver's license. An exception to this regulation is made on a few Forest Service roads specifically designated by the Forest Supervisor.

(Franklin Seal, Southeast Utah Organizer, Southern Utah Wilderness Alliance) [LARGER IMAGE] Christmas Eve, 2004, near the town of Bluff in southeastern UtahThere was a biting chill in the afternoon air, despite cloudless sunny skies that reflected off the powdery desert sand and the red sandstone canyon walls. Except for an occasional rumble from passing cars on the distant highway, the quiet remained unbroken until eight men appeared, perched on motorcycles and quad runners and covered head to toe in protective clothinghelmets, goggles, and gloves. Surveying the open expanse, they revved up the engines of their machines. Ignoring the United States government sign cautioning visitors about the cultural treasures in the sand, the men ran their vehicles up and over the hills and washes. After several hours on the sand dunes, the men tired of their sport and departed, leaving behind clouds of dust and a swath of tire tracks cutting across the fragile desert landscape, a visible scarring that would take months if not years for the land to recover. Bluff town resident Lynell Schalk photographed the damage and picked up the empty beer cans and litter that the men had left. "They left trash behind and ran over three archaeological sites on top of the dune behind my house," she says. A former Bureau of Land Management (BLM) ranger and special agent, Schalk spent much of her career investigating archaeological theft and trafficking in the Southwest and California. Despite her report to the local BLM field office in Monticello, Utah, she says nothing was done. "The BLM has written it off as a sacrifice area," she says.

All Terrain Vehicles (ATVs), commonly referred to as four-wheelers, and other Off Road Vehicles (ORVs or Off-Highway Vehicles - OHVs) are facing increasing regulatory pressures. The growing popularity of these recreational vehicles has resulted in grassroots movements to protect sensitive, natural areas from intrusion by ORVs. These vehicles can easily inflict damage to the landscape and there is also an emerging issue related to safety, children and ORVs. With public opinion on the side of reasonable environmental protection and safety, the debate boils down to a discussion on how much regulation is too much when it comes to limiting the access of ORVs to our public lands.
Authority Issues:
California Wilderness Coalition has a nice section of their web site devoted to information on a section of the RS 2477 Statute that was part of the Mining Act of 1866. The legislation was enacted at a time when road-building was essential to economic expansion. It reads in its entirety: "The right-of-way for the construction of highways over public lands, not reserved for public uses, is hereby granted."

Off-Road Vehicles Off-Road vehicle registrations in Manitoba are governed by the Off-Road Vehicles Act An off-road vehicle, or ORV, is any wheeled or tracked motorized vehicle designed or adapted to travel cross-country on land, water, ice, snow, marsh, swamp land or other natural terrain. Snowmobiles, all-terrain vehicles, dune buggies and dirt bikes are some examples of ORVs. Examples of vehicles not considered to be ORVs are: a golf cart, a garden or lawn tractor, a special mobile machine, a farm tractor and a farming implement. Registration Requirements No one under the age of 16 is permitted to register an ORV. Persons between 16 and 18 may register if they provide written consent from a parent or legal guardian. When registering, you may be asked to provide an official birth certificate or other acceptable proof of age. For new registrations, you'll receive a licence plate in addition to the registration/insurance certificate. For a renewal registration, you'll receive a validation sticker to affix to the plate. On snowmobiles, the plate should be fastened on the left side in the space between the lower edge of the seat and the running board, as close to the rear of the vehicle as possible. On ORVs with three or more wheels and on tracked vehicles other than snowmobiles, the plate should be fastened in a highly visible location on the rear of the vehicle. For two-wheeled ORVs, the plate should be mounted in a highly visible location on the front of the vehicle.

Off-road vehicles out of control, federal rangers say

WASHINGTON — Dirt bikes, dune buggies and all-terrain vehicles are wreaking havoc on public lands, posing significant law enforcement problems for federal rangers throughout the Southwest, according to a survey released Tuesday. The survey, conducted by Public Employees for Environmental Responsibility, comes as the U.S. Forest Service and the Bureau of Land Management are working on plans to set aside certain roads, trails and tracks that can be used for off-road vehicles. The agencies want to ban the vehicles anywhere else on the 705,000 square miles of federal land they manage. The two agencies manage about a fifth of the land in the country.

COW Meetings News Take Action Saturday, April 5th from 9:00am to 4:00pm at the Joshua Tree Community Center . Joshua Tree Community Center located at 6171 Sunburst Road in Joshua Tree. In 2005, COW and ARR organized a conference on ORV abuse attended by residents by many different desert communities. The event was a great success and helped to launch many successful initiatives to obtain law enforcement and to protect our precious desert lands and our quality of life. Community ORV Watch (COW), the California Wilderness Coalition (CWC), the Morongo Basin Conservation Association (MBCA), the Desert Protective Council (DPC), The Mojave Land Trust and the Alliance for Responsible Recreation (ARR) (partial list) is organizing another conference for updates, information and the development of effective strategies.

An estimated 5 million off-road recreational vehiclesmotorcycles, minibikes, trial bikes, snowmobiles, dune-buggies, all-terrain vehicles, and othersare in use in the United States today, and their popularity continues to increase rapidly. The widespread use of such vehicles on the public landsoften for legitimate purposes but also in frequent conflict with wise land and resource management practices, environmental values, and other types of recreational activityhas demonstrated the need for a unified Federal policy toward the use of such vehicles on the public lands. NOW, THEREFORE, by virtue of the authority vested in me as President of the United States by the Constitution of the United States and in furtherance of the purpose and policy of the National Environmental Policy Act of 1969 (42 U.S.C. 4321), it is hereby ordered as follows:

That's the verdict of a new coalition of former public land managers and rangers, which has formed to bring attention to the problem. Understaffing, weak penalties, and lack of enforcement of trail restrictions, among other problems, have led to environmental degradation and an increasingly chaotic environment at many popular federal recreation areas that are overwhelmed by the sheer numbers of off-road-vehicles (ORVs), the coalition says. "These things are just crawling all over the place, unregulated, damaging the environment and wreaking havoc - there's no teeth in any law enforcement," says Jim Baca, a member of the Rangers for Responsible Recreation coalition and a former director of the Bureau of Land Management (BLM) under the Clinton Administration. "Congress needs to look at this and make sure public land agencies are doing their job."

Off-Road Vehicles Shattered Solitude: Off-Road Vehicles on our Public Lands Photo by Kirk Condyles All across America, irresponsible and illegal off-road vehicle (ORV) use - driving all-terrain vehicles, four-wheelers, motorcycles, swamp buggies, jet-skis and snowmobiles off designated routes and into the back country - is threatening our national parks, wildlife refuges and other public lands. Off-road vehicles pollute our air and water, degrade wildlife habitat, and carve countless miles of new roads into wildlands. More than twenty years ago, the White House Council on Environmental Quality had already recognized that: “ORVs have damaged every kind of ecosystem found in the United States... In some cases the wounds will heal naturally; in others they will not, at least for millennia.” Sadly, not only do these abuses continue on our public lands today, but in many areas ORV use has increased dramatically. In addition, the machines themselves have become bigger, faster, and more destructive.

Arizona monument planning partial off-road vehicle ban

Rotstein ASSOCIATED PRESS 8:01 a.m. December 25, 2007 Bureau of Land Management staffers are working on a closure, likely in January, for the northern third of the Sonoran Desert National Monument, said program field manager Kevin Harper. Harper and others said riders who have ignored postings and other restrictions, taking their three- or four-wheelers and dirt bikes off designated roads, have carved new trails and mangled often-fragile vegetation. In doing so, they've created ugly, landscape-scarring ruts and other problems for the desert ecology. Damage from off-roading is a phenomenon being seen increasingly on public lands across the West as more people take up such recreational use, land use managers, conservationists and others say.
