This is the major implication of a ruling in the High Court yesterday over the sale in the UK of 'mod-chips' for the Sony Playstation. Channel Technology Sony last month won an injunction to stop the company from selling or marketing PS mod-chips. While not disputing the facts, Channel Technology argued that the mod-chip "was not 'specifically' designed to circumvent the copy-protection mechanism of the PS2 console, but also dealt with defeating the region control aspect of the same protection, and thus allowed arguably legal functions such as the use of imported games". Judge Jacob disagreed. Although extremely sceptical of Sony's claims, he ruled, according to Channel Technology's paraphrased account, that:

More accurately, digit D appears as the first digit with the frequency proportional to log (1 + 1/D) . In other words, one may expect 1 to be the first digit of a random number in about 30% of cases, 2 will come up in about 18% of cases, 3 in 12%, 4 in 9%, 5 in 8%, etc. This is known as Benford's Law . (I am grateful to Sara-Jayne Farmer for the idea to juxtapose Benford's Law with the result on distribution of digits discussed elsewhere. She also pointed me to a very fine article on Benford's Law in New Scientist (July 10, 1999, pp 26-30.) The law was discovered by the American astronomer Simon Newcomb in 1881 who noticed that the first pages of books of logarithms were soiled much more than the remaining pages. In 1938, Frank Benford arrived at the same formula after a comprehensive investigation of listings of data covering a variety of natural phenomena.
