Paul Cassell and the Goblet of Fire By Edward Cohn
Issue Date: 0.0.00
Print Friendly Email Article W arning: The editorial comment you are about to listen to has not been endorsed by the management of the College of Law. Most academic commentators have arrived at contrary opinions. Butdarn itI'm right." Paul Cassell, a law professor at the University of Utah, often flashes this message to his students on an overhead projector. He is probably the nation's best-known conservative challenger to the legal status quo, and he revels in the role. In June, however, he seemed for a moment to have been stopped in his tracks. The Supreme Court upheld its 1966 Miranda ruling (made famous by TV police dramas in which suspects are told, "You have the right to remain silent... .") by the surprisingly wide margin of seven to two, decisively rejecting the legal reasoning behind Cassell's eight-year crusade to overturn the decision. But Cassell has promised to find other ways to press the issue, and Miranda , in any case, is just one of Cassell's three passions. He is also a leader in the movement for a victims' rights amendment to the Constitution. (He represented the families of 89 victims in the Oklahoma City bombing trial.) And in the midst of a growing debate about the death penalty, Cassell has emerged as the academic world's foremost defender of capital punishment.

Roy Cohn
Mob Lawyer In his late years Roy Cohn, a major figure in McCarthy-era anti-communist activities, became a popular lawyer for top mafiosi, including Fat Tony Salerno, Carmine Galante and several members of the Gambino crime family . Among the latter were Carlo's sons Tommy and Joe Gambino, Carmine Fatico, Angelo Ruggiero and John Gotti If not for Cohn's counsel, Gotti's career might have ended more than a decade before he catapulted to boss of the Gambinos. In 1973 Gotti was looking at a long prison term for a killing he participated in at the orders of Godfather Gambino . The victim was James McBratney, who had kidnapped for ransom and killed one of the don's nephews. Gotti and two other hoodlums, Ruggiero and Ralph Galione, cornered McBratney in a Staten Island bar. They flashed phony police badges and tried to hustle their quarry away to a more private location where he could be dispatched in the horrible fashion the don wished. McBratney was not fooled and resisted. Galione produced a gun, which he was forced to turn on menacing bar patrons. A drunk tried to intervene and the gun went off accidentally. Galione panicked and fired three shots into McBratney. The job had been slightly botched, but Gambino was not displeased. Unfortunately witnesses easily identified the killer trio, and Tuggiero and Gotti were arrested. In the meantime gunner Galione had been shot dead, apparently by McBratney pals.

Israeli Refusers Resist the Wall
By Paul Pierce, Quaker International Affairs Representative Palestinians, Israelis and Internationals protest the construction of the Separation Wall in the town of Bil'in. Photo: Paul Pierce Eyal Brami at the Bil'in demonstration. Photo: Paul Pierce Ha'aretz reported ( MK Barakeh hurt by stun grenade at anti-separation fence rally , 4/28/05) that agent provocateurs employed by the Israeli government threw stones during the otherwise nonviolent protest. The Israeli agents proceeded to pull guns from beneath their clothes and arrest youths who also took up stone throwing. Alex Cohn at the Bil'in demonstration. Photo: Paul Pierce Nearly a dozen protesters were injured by tear gas and rubber bullets during the four-hour ordeal. Mohammed Barakeh, an Arab member of the Israeli Knesset, was choked by an Israeli soldier and was injured when a tear gas canister went off at his feet. Israeli peace activist Uri Avnery was thrown to the ground by an Israeli soldier. This is not the first time undercover agents of the Israeli military were used to incite violence in an otherwise nonviolent demonstration. In July 2004, during a demonstration against the Separation Wall in A-Ram, undercover agents threw stones at soldiers and border police and then turned on other youths who did like-wise and proceeded to arrest them. This is an ongoing tactic utilized to discredit and destroy nonviolent protest activities and provoke violence against the demonstrators by the armed forces.

'A PASTOR TO THE WORLD'
MILLIONS MOURN THE PASSING OF POPE JOHN PAUL II Sunday, April 03, 2005 By Bruce Nolan Staff writer Pope John Paul II, the Polish intellectual whose strong-willed, activist papacy helped undermine the Soviet Union, redefined the office's relationship to the world and dominated the billion-member Roman Catholic Church for more than a quarter century, died Saturday after a long and conspicuously public struggle with Parkinson's Disease. He was 84. John Paul died at 9:37 p.m. in Vatican City, or 1:37 p.m. New Orleans time. Frail and immobile, he died after a urinary tract infection spread and he suffered heart and kidney failure, the Vatican said. But the final infection was merely the latest complication in a series of disabilities that beset the pope as the neurological disease progressively tightened its grip after becoming noticeable in 1993. John Paul lost his ability to walk more than a year ago, then more recently, his ability to speak. Twice in February he was hospitalized, the last time to perform an urgent tracheotomy to help him breathe. Yet until nearly the very end he maintained some semblance of a public schedule. He was wheeled from event to event; aides read his speeches as he sat, silent and nearly immobile, nearby.

I came to Igloolik in 1966. There was no TV in Igloolik in 1966. The community kept voting TV out, twice, because the CBC had no Inuktitut programming. Before TV came, we used to go to our community hall, which had 16mm movies. At the age of twelve I started doing sculpture and would sell them to my teachers to make a little money, because it cost a quarter to get in. I would try and finish carving before the show time, filing away. I would sometimes be late, but most of the time I made it. I remember watching movies with cowboys and Indians and John Wayne and the cavalry. I was watching this movie one evening and John Wayne was my man. We were in the fort and he sent out scouts. I was one of the soldiers, and so we went out and didn't come back. The soldiers were dead, and there were soldiers and horses with arrows in them everywhere. I asked, "What kind of Indians did this?" Because I was thinking like those soldiers. As I got older and saw myself as an aboriginal person, I learned that there are two sides to every story. As I got older, I continued doing good sculptures in soapstone, carving for more money. I learned I could own 35 mm cameras, experimenting with different types of cameras and different scenes, documenting the hunt. But then came the moving camera. So one day in 1980, I heard that any breathing person could own a moving picture camera. And that was the day I decided I got to have one. With my carving buddy, who also played Atanarjuat, Natar Ungalaaq, we spent two weeks carving. We flew down and I traded my carvings for a Betamax camera, portapak and a VCR and I bought myself a 26 inch TV.

The Gnosis of Homo sapiens
Gnosis is a term which means 'knowing' - subjective inner-knowing or insight, as opposed to analytic knowledge. Gnosticism is broadly the following which seeks and celebrates this form of direct knowing. In a narrower sense it is applied to the gnostic movement of early Christianity. The Gnostic Background in the Perennial Philosophy All religions in some sense claim to take us to the core of enlightenment. They apporach it in different ways. Although some Christians were professed mystics, despite coming within the orthodox tradition, in Christianity generally there is an attitude that forgiveness of sins comes only through Christ who is God, not through the transcending of ignorance in our own self-realization. Both the Vedantic tradition and Buddhism have embraced deeply this path of self-realization and convey some of the deepest insights within their traditions. Sufis also have such insight traditions as does the Kabbala. At an opposite extreme, nature shamanism has retained a primal sense of intimate spiritual contact with nature and with circumstance as had Taoism. Gnosis represents for Christianity the lost esoteric tradition which claimed to carry the inner teachings of Jesus. This puts gnosticism in a very special position. Of all traditions and in common to the Jewish, Christian and Islamic traditions Christ has a unique status as the herald of the transformative epoch. The two millennia of Christianity pivots on this sense of historical culmination. For Buddhism and Vedanta, the epochs culminate in the Kali-yuga but in a more endless cyclic manner in the round of incarnation and the void.
