A History of Child Marriage in India

Mother: Really, I am telling you, I will cut off your ears and send them to the mill, and they will make flour and we will have bread from that. Daughter: Don’t be silly. Introduction: The Reform Movement 1860 - 1886 In India during the 1860’s, marriage meant girls getting married below 8 or 9 years old. Socio-reform religious movements such as the Brahmo Samaj and the Arya Samaj pioneered work against child marriage. Late in the 1860’s some success was met when the Indian Penal Code prohibited intercourse with a wife who had not reached ten years of age. Nevertheless, it wasn’t until 1880 that child marriage as a problem became a public issue in India during the debate on the Age of Consent Bill. Towards the end of the debate a child wife of eleven years old, Named Phulmani, died when her husband raped her. More than 500 women doctors sent a memorandum to the Viceroy requesting him to stop marriage of girls below 14 years of age. The resulting bill compromised at 12 years old. On August 15, 1884 a Parsee reformist, Behramji Malabari, circulated two notes which highlighted the evils of child marriage and enforced widowhood. The Honorable J. Gibbs added his comments to Malabari’s notes saying that, "Young mothers become stunted in growth, and often become invalids for life, while children were too often pony and weak." Kadhavdas added to the list of evils, "Early marriage is a great obstacle in the progress of female education."

Date: June 24, 2001 A 3,000-year-old ritual was resurrected at Panjal in Kerala in April 1975. A 12-day Agnicayana, or Atiratra, was performed on a bird-shaped altar of a thousand bricks. The altar was a geometricians' delight. The area of each layer of the altar, for instance, was seven and a half times a square purusa, the size of the sacrificer or the Yajamana. A fifth of the size of the Yajamana, panchami, was the basic unit of the bricks. The rules for measurement and construction of sacrificial altars are found in the Sulba Sutras, the earliest documents of geometry in India. Sulba means cord. Of the various Sulba Sutras, those of Baudhayana, Apastamba and Katyayana are best known. Scholars believe the sutras were composed during 800-500 BC. The mathematical knowledge in the texts comes from the creation of altars or bricks in various shapes-rhombus, isosceles trapezium, square, rectangle, isosceles right-angled triangle or circle. A square-shaped altar sometimes had to become circular without any change in the area or vice-versa. Obviously, the authors of the Sulba texts knew the value of pi, which is the ratio of the circumference to the diameter of a circle. The theory of right angles is attributed to Greek philosopher Pythagoras (6th century BC). But Baudhayana mentions that the diagonal of a rectangle produces by itself both (the areas) produced separately by its two sides. In simple terms, this means that the square of the diagonal is equal to the sum of the squares of two sides. In the next rule he says that the rectangles for which the theorem is true have the sides as 3 and 4 [32+42=52], 12 and 5, 15 and 8, 7 and 24, 12 and 35, 15 and 36. The theorem is given in all the Sulba Sutras.

The altar would have been knee-high. Its area is quoted as 7 1/2 square purushas; a purusha being the height of a man with uplifted arms (given as 120 angulas, i.e. 7 1/2 feet or 2.3 m), the area works out to 56.25 sq.ft. or 5.29 sq.m. Vedic fire-altars were of two kinds: there were the perpetual ones (nitya) and the optional ones (kamya). The syena -cita is an optional fire, meant for those who desire heaven (suvarga-kama, 8.1). It is constructed in the likeness of the falcon, after the shadow cast by it while flying (utpatatam chaya.ety.arthah , 8.5). The falcon shape is symbolic; the Taittiriya Samhita says, "He who desires heaven may construct the falcon-shaped altar; for the falcon is the best flyer among the birds; thus he [the sacrificer] having become a falcon himself flies up to the heavenly world."

Eka-Agni Kanda Apastamba Mantrapatha Agni has always placed a central part in all of our samskaras. In general, we may divide our samskaras into two: grihya samskaras, and shrauta samskaras. The former are performed in the household fire, and the mantras used therein are found in the mantrapatha, also known as the ekagni kanda. In the Apastamba kalpasutras, the ekagni kanda forms the 25th and 26th prashnas, while the grihyasutras form the 27th prashnas. Some hold the view that these mantras predate both the rishis Apastamba and Baudhayana. i.e. they are a body of mantras presupposed by both rishis, and included in the Apastamba kalpa sutras for completeness. According to this view, the Apastamba grihya sutras presuppose the ekagni kanda, and the ekagni kanda presupposes the grihya samskaras (and do not newly establish them). A few mantras used in the Apastamba grihya sutras are not found in the ekagni kanda, but are found in the grihya sutras themselves. A few other are found in neither place. Indeed some of the mantras founde in the ekagni kanda are not found in the extant vedic corpus, although some of the mantras are variations of extant mantras. We can safely say that those who follow the sutras of Rishi Apastamba belong to the Taittireya shaka of the Krishna Yajur Veda. Of the 138 mantras occuring in the Taittireya vedic corpus, 117 mantras occur as is, and 21 are variants of mantras occuring therein. It is closely related to the grihya sutras belonging to the Krishna Yajur Veda (Baudhayana, Bharadwaja, Hiranyakeshi). Where variations of the mantras occur, all frequently make use of mantras with the same variations. Although all the sutrakarakas frequently make use of the same mantras, they are often prescribed for use in slightly different portions of the rites.
