Introduction Table of Contents State v. Brewer , 170 Ariz. 486, 826 P.2d 783 (1992) PROCEDURAL POSTURE: The defendant was convicted in Superior Court (Coconino) of first-degree murder and was sentenced to death. This is the defendant's automatic, direct appeal to the Arizona Supreme Court. AGGRAVATING CIRCUMSTANCES: (F) (3) (Grave Risk of Death to Others) - REVERSED
The defendant murdered his pregnant girlfriend. The trial court found this aggravating circumstance based on the grave risk of death to the fetus. The Court found that this aggravator did not exist because the defendant acted with intent to kill the fetus. (F) (6) (Heinous, Cruel or Depraved) - UPHELD Cruel: Upheld.
Mental Anguish: Found. "Cruelty is defined as the infliction of pain and suffering in a wanton, insensitive, or vindictive manner." 170 Ariz. at 501. The Court found that the victim was told she was going to be killed and a forty-five minute struggle ensued, throughout which the victim was conscious. Consciousness was demonstrated by the victim's resistance to the attack. The Court found that the victim must have experienced "anguish and terror" during the struggle, knowing that defendant planned to kill her. 170 Ariz. at 501.
Physical Pain: Found. During the attack, which the victim resisted in every possible way, defendant beat, strangled, pounded on, and threw the victim. Defendant bashed her head against a wall, attempted to break the victim's arms by smashing them against a dresser, tried to gouge out her eyes, causing severe eye damage in the assault. Defendant bit the victim multiple times, bruised most of her body, and prevented her attempted escape. Defendant finally choked the victim three times until he believed she was dead. "The victim's ordeal, moreover, was sufficiently prolonged and painful to warrant a finding of cruelty." 170 Ariz. at 501-502. The medical examiner testified that the injuries suffered by the victim would have inflicted enormous pain, particularly the eye injury.

This lucidly written and cogently argued work is the next step in the development of intersubjectivity theory. In particular, it is a clinically grounded continuation of Stolorow and Atwood's Contexts of Being (TAP, 1992), which reconceptualized four foundational pillars of psychoanalytic theory the unconscious, mind-body relations, trauma, and fantasy from an intersubjective perspective. Atkinson, George Wesley Atwell, William Hawley , attorney-general of Texas, was born June 9, 1869, in La. Crosse, Wis. He attended the Dallas public schools, Texas; the Southwestern University, and the State University. In 1889 he was assistant attorney of Dallas County; in 1894 was nominee for attorney-general of Texas. He has been secretary of the State Republican League ; of the National Committeeman League in 1896; and is a prominent member in various societies. He is one of the finest speakers in the south, his oratory being strong, sparkling and convincing. Since 1898 he has been United States district attorney; and resides in Dallas, Tex. He is the author of Atwell's Federal Criminal Law.

CALL TO ORDER Village President, George Dunbar, called the meeting to order at 7:00 p.m. II. PLEDGE OF ALLEGIANCE The assemblage recited the Pledge of Allegiance. III. AUDIENCE No one addressed the Board at this time. IV. BUSINESS A) FRED DUPLESSIS RE: FY97 AUDIT. Fred Duplessis addressed the Board, noting that the Village complies 100% with all accounting rules and regulations. Fred Duplessis reviewed the FY`97 audit with the Board, including revenues and expenditures for the year. Fred Duplessis reviewed the recommendations from the auditors, including completion of an accounting procedures manual for the Village. Some of the other recommendations have already implemented by the Village, noted Duplessis. B) CIRCUMFERENTIAL HIGHWAY Art Hogan appeared before the Board to answer any questions on the resolution in support of completion of the Circumferential Highway through Williston to I-89. Art Hogan said it appears that MPO will also be in support of this project. Charles Safford stated Essex Town, Colchester and Williston have already signed the resolution.

January 27, 1998 MEMBERS PRESENT:
Village President, George Dunbar; Larry Yandow, Steve Atwood, George Boucher. (Ken Mitchell was absent.) ADMINISTRATION: Village Manager, Charles Safford. I. CALL TO ORDER Village President, George Dunbar, called the meeting to order at 7:00 p.m. II. PLEDGE OF ALLEGIANCE The assemblage recited the Pledge of Allegiance. III. AUDIENCE No one from the audience addressed the Board at this time. IV. BUSINESS Water Agreements MOTION by Steve Atwood, seconded by George Boucher, to approve the contracts known as the "Retail Water Rate Agreement" and the "Water Supply Agreement" as executed on January 27, 1998. VOTING: 4 ayes; motion carried. Channel 17 Lauren-Glenn Davitian, Channel 17, addressed the Board and stated that over the past seven years Channel 17 has worked to increase the range of programming, upgrade the quality of programming, and increase subscribers. Channel 17 has also improved its audio and video equipment. Ms. Davitian urged anyone presenting before the Board to use a microphone to ensure quality audio. Ms. Davitian reported negotiations between Channel 17 and Adelphia are in progress. The current agreement expires in 1999. Operating and capital levels and Adelphia upgrading its system will be discussed. George Dunbar added the Channel 17 Board is optimistic the negotiations will go well.
