Mark Stern, M.D. Facts: In January 1991, 52-year-old claimant Merle Jensen, a cafeteria worker, sustained a back injury following a fall at work. After x-rays revealed a Grade I spondylolisthesis at L4-5 with radiculopathy, and following a conservative course of treatment which did not significantly improve her condition, plaintiff was referred to respondent Mark Stern, M.D. Dr. Stern performed surgery on plaintiff on July 15, 1991. His preoperative diagnosis was segmental instability at L4-5 with lithiasis and disc herniation at L4-5, and right sciatica. His postoperative diagnosis was the same, except for dysplastic pedicles at L-4 on the right side, for which he was forced to use a "claw configuration" on that side. He did an instrumental fusion at L4-5 with the use of pedicle screws on the left, and a "claw configuration" extending from L3 to L5. Claimant's condition improved until October 1991, when she began to experience discomfort. X-rays revealed that one or more of the pedicle screws used for fixation were not in the pedicles but in soft tissue. Claimant returned to work in January 1992, with respondent's permission, but complained to him the following month of a recurrence of dysfunction in her right leg and back. A CT scan and lumbar myelogram indicated that none of the pedicle screws were in the pedicles but in soft tissue, that portions of the fixation devices were fractured, and there was a developing spondylolisthesis that had not existed prior to surgery by respondent.

The week before her death, Julie told Margaret that Mark would kill her before he would divorce her. Douglas was probably at daycare, which he started that week. Julie was applying for jobs (Mark wanted her to work), but she hadn't heard back about them. She didn't want Douglas, who was 4, in daycare. The Tuesday before her death, she asked Julie if she really believe Mark would kill her. Julie said, "yes." Margaret asked if she could help. Julie said no, that Mark was being good to her. Cross examination ~ On the call the day before she died, did Julie say she was afraid? No, Margaret started seeing Kelly at the house around January and more in the spring. Did Julie tell you she saw a doctor for depression? No. Did she tell you the doctor gave her anti-depressants? No. The next witness is Aaron Dillard. The first person to speak was Mrs. Jensen, Mark's mother, a very lovely and sweet lady. She spoke in a very light hearted way which I believe set the tone of the service. At that point it seemed to me to become a celebration of life. Paul Duus then spoke about when he came to The Dalles High and how Mark had become not only a friend but a mentor. He spoke of Mark being blessed by God both intellectually and physically but still being well grounded and having a great sense of humor. [I would have to agree that Mark was blessed but I know that some times I got by Mark and caught a trace of sulphur. I mean Mark wasn't above raising some hell every once in a while] The Pastor spoke next and told anecdotes about Mark which reflected how he felt about his family, friends, and even people he had just met. He loved his family, he loved his friends, and he genuinely liked people. After the service a group of us [see tribute for Mark] were invited by Dennis and Mary Davis to come to their home to talk and reconnect. I would like to say that Dennis and Mary could not have been more gracious in allowing us the use of their home. There were approx. twenty of us and we seemed to all get a chance to talk to everyone else one-on-one which was refreshing. George Vass then addressed us all and told of his memories and impressions of Mark, then Paul Duus and then Steve Lawrence.
