May 15, Panel 3 EFF 3rd Proposed Exemption - Foreign audiovisual works and movies released on non region 1 DVDs and not otherwise available in the United States As Mr. Attaway of the Motion Picture Association of America stated in his testimony before this rule-making on May 2, The parties opposing this exemption have made four main arguments: First, the joint commenters have argued that EFF has not met its burden of proof of establishing harm amounting to a substantial adverse impact on noninfringing uses. They deride the figures provided in EFF's comments for the numbers of movies from Australia, Japan, and India, that are not released in the US on region 1 DVD format in the United States, as being "somewhat suggestive of the number of titles in this class and the U.S. demand for them, but they are presented in a way that tends to exaggerate both these qualities." However, the joint commenters have criticized only the figures provided for Indian movies and have not disputed the figures provided for (region 4) Australian movies or (region 2) Anime works.

Email usito @usito.org Tuesday, August 23 As USITO prepares our annual comments on China's WTO compliance, it may be useful for members to read China's assessment of US trade practices, starting on page 110 of the linked document. Practices relevant to the IT industries that China perceives to be unfair include growing reliance on anti-dumping cases that are based on dubious standards, bilateral and regional agreements that afford preferential treatment to certain countries, the procurement preference for U.S. goods and services, and export restrictions on dual-use technologies.
Friday, July 7 Bride of DTV: Something Old, Something New: Unable to choose among technologies vying to become China's standard for digital television, authorities are now picking features of three finalists and combining them into what they claim will be a mature technological platform before the year is out. "Once the solution gets approval from [the National Development and Reform Commission], equipment manufactures will be able to use the new solutions to produce new chips," said Yang Xingzhi, director of DTV Standardization Work Coordination Group under MII, in a press conference.
The State Administration of Radio, Film, and TV (SARFT), which oversees television development, plans to build a national digital cable TV system by the end of this year, with programming, a transmission system, reception systems, and an administrative system. A live digital satellite platform will go up in 2006 to cover remote areas. In 2008, according to the master plan, China will start large-scale application of mobile digital TV and high definition TV technologies. Broadcasting of analogue TV will be terminated by 2015, if not before.

Exporting to the United States
Goods, of course, are not the only marketable things a company may possess. For many businesses, their intellectual property and/or proprietary technology can be their most valuable assets. Because these assets are intangible, they can be difficult to protect and easy to misappropriate. Several legal methods have been developed to protect them. The major ones are:
Patents
Patents are granted for new inventions (such as processes, machines, manufacturing techniques or the composition of substances), or any new and useful improvement of an existing invention, and are intended to prevent people or businesses from making, using or selling them without the patent owner's permission. As defined by the United States Patent and Trademark Office , a patent is "the right to exclude others from making, using, offering for sale, or selling the invention in the United States or importing the invention into the United States". In the U.S., industrial designs are considered "design patents" and are also handled by the Patent Office. Note that a U.S. patent gives no protection outside the U.S.
