Juriste et penseur politique français, 1805-1859 Sa vie en bref Aristocrate français né à Paris, en 1805, Alexis de Tocqueville est issu d'une famille ultra-royaliste partiellement décimée par la Terreur qui suivit la Révolution française de 1789. Pour cette raison sans doute, il se méfiera toute sa vie des intentions révolutionnaires sans pour autant verser dans un conservatisme à tout crin. De fait, cette méfiance ne l'empêchera pas d'être un libéral engagé, lui qui vivait justement à une époque où la France tentait maladroitement de réfréner la montée des revendications sociales mises de l'avant à la faveur de la Révolution française. Auparavant, le jeune Tocqueville aura toutefois pris soin de poursuivre ses études en droit avant d'être nommé juge auditeur en 1827, à Versailles. L'état de sa société suscite par ailleurs de profonds déchirement chez Tocqueville, le laissant écartelé entre les traditions familiales et ses sympathies naturelles à l'égard d'un système politique plus démocratique, à l'image de celui développé par les Américains depuis 1776. Et cette sympathie était d'autant plus importante que ses lectures de Châteaubriand l'avaient convaincu que la liberté américaine avait plus à voir avec la liberté des Lumières que celle des primitifs dépeinte par Rousseau. Un voyage d'étude de neuf mois aux États Unis, voyage qui devait permettre au juriste qu'il était d'étudier le système carcéral américain considéré par les philanthropes d'alors comme étant le plus évolué de l'époque, allait d'ailleurs lui permettre de vérifier de près les thèses de Châteaubriand. En fait, bien davantage un prétexte pour fuir momentanément son pays où son engagement politique lui vaut quelques inimitiés qu'un véritable voyage d'étude, il profite de son séjour pour cumuler une importante quantité de notes sur la vie politique américaine.

Gertrude Himmelfarb has written a most helpful introduction to this little known work (it was not even translated into English until 1968) by the great Alexis de Tocqueville, and I rely on her for the background to the book. Visiting England in 1833, de Tocqueville was struck by the prevalence of pauperdom in this most prosperous of nations. In 1835, shortly after the first volume of Democracy in America was published, he delivered this lecture to the Royal Academic Society of Cherbourg. Himmelfarb suggests that he may have been influenced by J. B. He studied law in Paris (1823-1826) and then was appointed an assistant magistrate at Versailles (1827). The July 1830 Revolution which, with middle-class support, put Louis Philippe on the throne, required a loyalty oath of Tocqueville as a civil servant. He was suspect because his aristocratic family opposed the new order and was demoted to a minor judgeship without pay. Tocqueville and another magistrate, Gustave de Beaumont, asked to study prison reform in America, then an interest of the French government. Granted permission but not funds (their families paid their expenses), Tocqueville and Beaumont spent from May 1831 to February 1832 in the United States. The son of an aristocratic and monarchist family, Tocqueville's travels in America, England, and Ireland led him to a reformist political stance in support of democratic institutions. Before traveling to America and after experiencing the social chaos and despotism in early-nineteenth-century France, Tocqueville suspected that democracy led inevitably to "a debased taste for equality, which leads the weak to want to drag the strong down to their level and which induces men to prefer equality in servitude to inequality in freedom" (1969 [1835-1840]: 49). He feared that this servile egalitarianism would lead to despotism by leaving people defenseless against public opinion. Alexis de Toqueville (1805-1859) was born in Verneuil, near Paris, during the reign of Napoleon I. Through his father, Herve de Tocqueville, Alexis is descended from Clerel de Tocqueville, who fought with the Normans under William the Conqueror at the Battle of Hastings in 1088 A.D. Herve de Tocqueville was a prefect during the Restoration at Angers, Beauvais, Dijon, Metz, Amiens, and Versailles. Alexis de Tocqueville’s mother, Louise, daughter of Louis le Peletier de Rosanbo, is the granddaughter of Lamoignon de Malesherbes, the noble who cautioned Louis XVI against absolutism and who was executed after his spirited defense of Louis XVI to the revolutionary tribunal. In the large Donner bookstore in Rotterdam, you will not find any book written by Alexis de Tocqueville in the split-level section, which contains philosophical masterpieces. Hobbes' Leviathan stands there, as does The Prince by Machiavelli, but no Democracy in America , nor On the French Revolution It's purposeful to get an idea of De Tocqueville's personal development as well as the time and era in which he grew up. This provides a useful picture of the turbulent time wherein revolutions and sudden power changes were commonplace. The assignment turns out to require much physical devotion. De Tocqueville and De Beaumont are able to wrestle themselves through extremely uncomfortable meteorological circumstances and reach quieter waters as they begin their research in the New York area.
During this period the two investigate how the correctional system in America functions in practice. The prisons in America seem to function well, in sharp contrast to the deplorable Medieval cachots of France. American prisoners need to work with each other during the day and are isolated only at night. The research of correctional facilities leads to a fascination for American politics.

The admired friend of men such as J. S. Mill, Tocqueville was elected to the Chamber of Deputies in 1839 and to the French Academy in 1841, and came to be regarded as an outstanding man, liberal but detached. Opposing the extremism of both Left and Right, Tocqueville, who in 1849 had served briefly as foreign minister of the Second Republic, retired from public life after Louis Napoleon's coup of 1851, and spent his remaining years in writing history and compiling his own Recollections, from which the following passages are taken.
