Lysander Spooner
Lysander Spooner was a Massachusetts lawyer noted for his vigorous and brilliant opposition to the encroachment of the State upon the liberty of the individual. In these three articles, you will find concepts and arguments that will challenge your thinking and what you have been taught about the law and the Constitution. It is easy to dismiss what appears to be subversive but we challenge you to consider where and from whom government gets it authority to be in control as it is today. Then ask yourself - Is this freedom or slavery? If Lysander Spooner cannot inspire a reexamination of everything you learned in high school, then nobody can.
No Treason #1 (1867)
Introductory The question of treason is distinct from that of slavery; and is the same that it would have been, if free States, instead of slave States, had seceded. On the part of the North, the war was carried on, not to liberate the slaves, but by a government that had always perverted and violated the Constitution, to keep the slaves in bondage; and was still willing to do so, if the slaveholders could be thereby induced to stay in the Union. The principle, on which the war was waged by the North, was simply this: that men may rightfully be compelled to submit to, and support, a government that they do not want; and that resistance, on their part, makes them traitors and criminals.

Lysander Spooner No Treason Introductory The question of treason is distinct from that of slavery; and is the same that it would have been, if free States, instead of slave States, had seceded. No principle, that is possible to be named, can be more self-evidently false than this; or more self-evidently fatal to all political freedom. Yet it triumphed in the field, and is now assumed to be established. If it be really established, the number of slaves, instead of having been diminished by the war, has been greatly increased; for a man, thus subjected to a government that he does not want, is a slave. And there is no difference, in principle-but only in degree-between political and chattel slavery. The former, no less than the latter, denies a man's ownership of himself and the products of his labor; and asserts that other men may own him, and dispose of him and his property, for their uses, and at their pleasure. Previous to the war, there were some grounds for saying that-in theory, at least, if not in practice-our government was a free one; that it rested upon consent. But nothing of that kind can be said now, if the principle on which the war was carried on by the North, is irrevocably established.

Lysander Spooner
"The right and the physical power of the people to resist unjustice, are really the only securities that any people ever can have for their liberties."
To me, the most important implication of Spooner's writings is that "coercive political systems" are hoaxes and frauds. (An exception would be a political system established via legitimate contract in which all parties to a political system enter knowingly, willingly, intentionally, and explicitly into a contract or constitution to create and operate the political system. I know of no current political system that satisfies this requirement.)
Thus I regard all pretended "countries," "states," "laws," "kings," "queens," "presidents," etc. as hoaxes, frauds, imposters, and liars. This includes that the notion that Bill Clinton is "president" of the "USA" is quite absurd. It's beyond me that a freedom lover who's read Spooner's 'Constitution of No Authority' can be so gullible as to believe that there's really a "USA" and that Bill Clinton is "its" "president."

THE RIGHT OF JURIES
TO JUDGE OF THE JUSTICE OF LAWS
Section I For more than six hundred years-that is, since Magna Carta, in 1215there has been no clearer principle of English or American constitutional law, than that, in criminal cases, it is not only the right and duty of juries to judge what are the facts, what is the law, and what was the moral intent of the accused; but that it is also their light, and their primary and paramount duty, to judge the justice of the law, and to hold all laws invalid, that are, in their opinion, unjust or oppressive, and all persons guiltless in violating, or resisting the execution of, such law. Unless such be the right and duty of jurors, it is plain that, instead of juries being a "palladium of liberty"-a barrier against the tyranny and oppression of the government-they are really mere tools in its hands, for carrying into execution any injustice and oppression it may desire to have executed. But for their right to judge the law, and the justice of the law

The Constitution of No Authority
by Lysander Spooner
I.
The Constitution has no inherent authority or obligation. It has no authority or obligation at all, unless as a contract between man and man. And it does not so much as even purport to be a contract between persons now existing. It purports, at most, to be only a contract between persons living eighty years ago. [This essay was written in 1869.] And it can be supposed to have been a contract then only between persons who had already come to years of discretion, so as to be competent to make reasonable and obligatory contracts. Furthermore, we know, historically, that only a small portion even of the people then existing were consulted on the subject, or asked, or permitted to express either their consent or dissent in any formal manner. Those persons, if any, who did give their consent formally, are all dead now. Most of them have been dead forty, fifty, sixty, or seventy years. and the constitution, so far as it was their contract, died with them. They had no natural power or right to make it obligatory upon their children. It is not only plainly impossible, in the nature of things, that they

Natural Law.
Part First.
Chapter 1.
The Science of Justice.
Section I.
It is the science which alone can tell any man what he can, and cannot, do; what he can, and cannot, have; what he can, and cannot, say, without infringing the rights of any other person. It is the science of peace; and the only science of peace; since it is the science which alone can tell us on what conditions mankind can live in peace, or ought to live in peace, with each other. These conditions are simply these: viz., first, that each man shall do, towards every other, all that justice requires him to do; as, for example, that he shall pay his debts, that he shall return borrowed or stolen property to its owner, and that he shall make reparation for any injury he may have done to the person or property of another. The second condition is, that each man shall abstain from doing to another, anything which justice forbids him to do; as, for example, that he shall abstain from committing theft, robbery, arson, murder, or any other crime against the person or property of another. So long as these conditions are fulfilled, men are at peace, and ought to remain at peace, with each other. But when either of these conditions is violated, men are at war. And they must necessarily remain at war until justice is re-established.

Acton, Lord
Acton was against "programmes of reaction" and thought that there could be great reliance on those institutions that came about as the result of slow evolution. That, ultimately, what was to be trusted were those "changes arising from special historical situations rather than from the minds of presumptuous men."

Bastiat, Frédéric
Bastiat was of the view that those who subscribe to socialism subscribe to putting in place mechanisms, a philanthropic tyranny, which would but force the human race (a futile effort) to behave as the social engineers think the human race ought to behave as opposed to how it behaves by nature.
Bentham, Jeremy
In Bentham's writings, politicians, beginning with those of the early 19th century, found legitimization in their most favoured activity: the business of making laws; and, they have been doing it in great quantities ever since. Bentham the business Bentham figured that laws should be socially useful and not merely reflect the status quo; he thought it to be a "sacred truth" that "the greatest happiness of the greatest number is the foundation of morals and legislation."
