    Assuming the work you wish to use is protected, your use is not a fair use or otherwise exempt from liability for infringement, and the work has not been licensed for your use online, you need permission. Now what?

    There are no foolproof methods to obtain permission, but there are steps likely to yield results. The steps will vary depending on the nature of the work you need to use. If the work is part of a book or a journal article, contact the ("CCC") first. The CCC now offers an experimental electronic permission service and a well-established photocopy based academic permission service. Definitely worth a try. Your library or copy center is probably already working with the CCC and should be able to help you. If the work you want to use is registered with the CCC, you can get permission within 24 to 36 hours. Permission during peak times like the beginning of fall semester will take longer.

The use of information in all environments, including within educational and research institutions, is governed by or intellectual property law. Everyone who uses information, everyone who uses a library, makes a copy of an electronic journal article on their computer, or even makes a photocopy, needs to know the law and how it applies to him or her. Do not assume that, because you are part of a university, all use you make of information falls under fair use or educational exemptions. This is not the case.

    The Federal Depository Library Program
    Franklin Pierce Law Center Library has been a selective Federal depository library since 1973 and is one of nine depository libraries in the State of New Hampshire. The Law Library's collection comprises 11.83% of the available item numbers in the Federal depository library program. It consists primarily of Congressional hearings, reports, prints and debates; Federal agency administrative decisions; U.S. Supreme Court decisions; the Code of Federal Regulations (CFR); the Federal Register; and Presidential documents and papers. Any individual entering the library who states specifically a desire to see a federal government document will be allowed access for that purpose. A member of the library staff will assist the patron in locating the document.

    There are three sets of congressional guidelines detailing fair use under Section 107: Guidelines for Classroom Copying in Not-For-Profit Educational Institutions with Respect to Books and Periodicals, Guidelines for Educational Uses of Music, and Guidelines for Off-Air Recordings of Broadcast Programming for Educational Purposes. An additional set of CONTU (do not confuse with CONFU) guidelines specify what can be photocopied in interlibrary loan arrangements under Section 108(g)(2).

    Yale University David Green Executive Director National Initiative for a Networked Cultural Heritage Jennifer Trant Executive Director Art Museum Image Consortium Providing easy access to digital collections of high- quality cultural heritage images that can be reliably used by scholars, teachers and others, has been a highly touted recent goal within the cultural community. The Getty's ground-breaking Museum Educational Site Licensing project highlighted many of the issues to be solved, from the management of intellectual property, to the implementation of interoperable information and technical standards, the formulation of best practices and the development of optimum distribution strategies. Now, several organizational models have emerged and this session will highlight three of them: an open, museum licensing consortium now in business, and two recently announced initiatives/research projects from major research library groups. How are these projects succeeding in solving the challenges identified a few years ago in developing sustainable cultural collections? How have those challenges been freshly identified and what new strategies are being developed to address them? What choices will we have in deploying quality cultural images and multimedia in research and teaching? What are some of the new issues that these initiatives are uncovering that we need to understand? Panelists will address these and related questions in their reports and in discussion with the audience.

    Washington, DC 20540-3120 Dear Ms. Peters: The National Telecommunications and Information Administration ("NTIA"), an agency of the United States Department of Commerce, "serves as the President's principal adviser on telecommunication policies pertaining to the Nation's economic and technological advancement." As a matter of policy established by Congress, among other objectives, NTIA seeks to promote "the benefits of technological development in the United States for all users of telecommunications and information facilities." Striking the appropriate balance among the complex and oftentimes competing interests of affected stakeholders is an indispensable component of formulating responsive policies that best serve the interests and needs of all Americans. This section provides in pertinent part: (a) Violations Regarding Circumvention of Technological Measures. (1)(A) No person shall circumvent a technological measure that effectively controls access to a work protected under this title. The prohibition contained in the preceding sentence shall take effect at the end of the 2-year period beginning on the date of the enactment of this chapter. In so doing, the statute instructs the Librarian to consider a number of factors, including those incorporating traditional notions of "fair use," in conducting the rulemaking.
