TrackBack Print E-mail TalkBack In its new "Unintended Consequences" report released Thursday, the Electronic Frontier Foundation ( EFF Hollywood studios, record labels and other intellectual property holders lobbied hard for the law, fearing that the Internet would become a forum for rampant piracy because it allows people to easily copy and distribute digital products. Unlike analog copies, which lose resolution with each replication, digital copies of products maintain their high quality. In its report, the EFF said aggressive applications of the law have reached beyond the intention of the measure. The EFF said the DMCA has had a threefold effect: chilling free expression and scientific research; jeopardizing fair use; and impeding competition. The study lists more than a dozen cases where intellectual property holders have wielded the DMCA in ways the EFF says are overly aggressive and chilling. The study cites cases including those of

Are you a technologist interested in helping out on civil liberties cases? Are you an attorney looking for some help understanding technical issues in lawsuits? EFF is setting up a listserv to help connect technologists to attorneys on cases that are core to EFF's mission but beyond what we can handle in-house.
Over the years, EFF has connected hundreds of tech-savvy lawyers with potential clients through our Cooperating Attorneys listserv. This has worked so well, we thought we'd provide the same service for those who need technical assistance on litigation and civil liberties issues.
Here's how the Cooperating Techs list will work: Attorneys needing technical assistance on cases will contact us and let us know what kind of help they need and whether they can pay. After we receive the request and determine if it is appropriate for our list, we'll post a note to the list with a basic description of the project. (For example: 'CA attorney needs a tech familiar with Microsoft Exchange servers to assist in recovering allegedly deleted email messages needed for lawsuit. Can pay reduced fee.')

John Perry Barlow
is a retired Wyoming cattle rancher, a former lyricist for the Grateful Dead , and co-founder of the Electronic Frontier Foundation . Since May of 1998, he has been a Fellow at Harvard Law School's Berkman Center for Internet and Society He was born in Sublette County, Wyoming in 1947, was educated there in a one room schoolhouse, and graduated from Wesleyan University in Middletown, Connecticut with an honors degree in comparative religion in 1969. In 1971, he began operating the Bar Cross Land and Livestock Company , a large cow-calf operation in Cora, Wyoming where he grew up. He continued to do so until he sold it in 1988. He co-wrote songs with the Grateful Dead from 1971 until their demise in 1995. The Economy of Ideas Selling Wine Without Bottles on the Global Net by John Perry Barlow Thomas Jefferson Throughout the time I've been groping around Cyberspace, there has remained unsolved an immense conundrum that seems to be at the root of nearly every legal, ethical, governmental, and social vexation to be found in the Virtual World. I refer to the problem of digitized property. The riddle is this: if our property can be infinitely reproduced and instantaneously distributed all over the planet without cost, without our knowledge, without its even leaving our possession, how can we protect it? How are we going to get paid for the work we do with our minds? And, if we can't get paid, what will assure the continued creation and distribution of such work? Since we don't have a solution to what is a profoundly new kind of challenge, and are apparently unable to delay the galloping digitization of everything not obstinately physical, we are sailing into the future on a sinking ship. Legal efforts to keep the old boat floating are taking three forms: a frenzy of deck chair rearrangement, stern warnings to the passengers that if she goes down, they will face harsh criminal penalties, and serene, glassy-eyed denial. Intellectual property law cannot be patched, retrofitted, or expanded to contain the gasses of digitized expression any more than real estate law might be revised to cover the allocation of broadcasting spectrum. (Which, in fact, rather resembles what is being attempted here.) We will need to develop an entirely new set of methods as befits this entirely new set of circumstances.

This site is a bunch of records that Matt(Att), Andrew(Rew), and I(Jeff a.k.a. Eff) have accomplished or witnessed while playing the NES game Tecmo Superbowl. We play on the computer through emulators as well as through our NES'. If you wanna be introduced to the 3 of us, go to the Personal Records page, where you will find the mini-bio section. Also, check out the rules and asterisk system stuff toward the bottom of this page to see how stuff works around here. In comparison to other personal TSB record sites, the numbers won't be enourmously inflated. This is because we follow a list of rules so the opportunity to throw for 500 yards in a game is pretty small. We all know how easy the cpu can be in Tecmo, therefor we try to make it more challenging by following a set of rules. Of coarse in general the stats in this game are inflated to real life, but our records aren't inflated for Tecmo itself. Am I getting repetitive? lol. Anyway, look around and see how lame we are, lmao. ~Eff~

EFF calls on public to fight broadcast flag
EFF has announced the Digital Television liberation project, calling on the public to build and aquire as many non-broadcast-flag-compliant legacy devices as possible before the July 1, 2005, effective date of the broadcast flag regulation. As part of this project, EFF will be teaching people to build their own personal video recorders (PVRs) with HD capability and no content-control restrictions. These devices will continue to work (and may lawfully be given away or sold) after the broadcast flag rule goes into effect next year. Unlike some contemporary commercial PVRs, they will not impose any technological restrictions on how you can use your recorded programming, and they will facilitate upgrades and enhancements. The initial focus of the PVR effort is on the impressive MythTV project, which already has DTV capability plus features that compare favorably with commercial PVRs. MythTV is a free software/open source project developed by Isaac Richards.

MPAA FAQ on Broadcast Flag
The MPAA published a FAQ on the broadcast flag. Our detailed comments below. Q: What is a broadcast flag? MPAA answer : The broadcast flag is a sequence of digital bits embedded in a television program that signals that the program must be protected from unauthorized redistribution. It does not distort the viewed picture in any way. Implementation of this broadcast flag will permit digital TV stations to obtain high value content and assure consumers a continued source of attractive, free, over-the-air programming without limiting the consumers ability to make personal copies. EFF comment : Digital TV stations can already obtain "high value content" it's only the Hollywood movie studios which are declining to license their movies for digital TV broadcast. That's the studios' choice, and that's the studios' right. EFF does not believe that the studios have to let their movies be broadcast on digital TV if they don't want to. However, the studios are asking the public, and Congress, to change the way all digital TVs work in order to make digital TV more attractive to Hollywood. That's not necessarily a good idea, especially because there are many content providers like HDNet and other TV networks who are perfectly happy with the way digital TV works right now.
