TWIST AGAIN (LIKE WE DID A FEW SUMMERS AGO)
So the Supreme Court has refused to take on the McFarlane/Tony Twist case, and it's being kicked back to the lower courts where it's to be retried. Despite the amicus briefs submitted by a flotilla of recognizable Hollywood names, this is not a First Amendment case. This is, and always has been, a Todd's-Being-A-Dick case. Years ago, when I was looking into the notion of suing someone for libel, my lawyer said thatin this great country of oursyou can say practically anything about someone as long as you stop short of characterizing him as committing criminal acts. So what did Todd do? In "Spawn," he named a criminal enforcer "Tony Twist" and openly copped to naming him after hockey player Tony Twist. (Un)surprisingly enough, the hockey player didn't cotton to having his name appropriated by a criminal character. My lack of sympathy for Todd in this has zero to do with our history (or his charming stunt of naming two members of the KKK "Peter and John" after Byrne and myself in another "Spawn.") If Todd had created a hockey character named Tommy Twitch who started pounding on other players in the first two seconds of a game, and Tony Twist sued, I'd be 100% on Todd's side. Fair use, parody, satire. Or if he'd had Tony Twist skate onto panel, wave, someone says "Hey, Tony!" and he skates off and Twist sued, again I'd be saying, "C'mon, the guy should be flattered. No harm was intended." If Todd weren't a hockey fan, never heard of Tony Twist (I know I hadn't before this), and it was pure coincidence, I'd support him.

Dodging a bullet
My esteemed colleague, Monsieur Evanier, on his website takes to task those in the industry whom he feels displayed excessive joy (although he used a fancy shmancy German word for it) over another's misfortune when Todd McFarlane initially was on the receiving end of a multi-million dollar judgment against him. Seems TMcF thought it would be funny to name a gangster character after real life hockey player Tony Twist in the SPAWN comic and TV show. Twist didn't think it was funny, sued him, and brought in testimony stating he'd lost $100,000 in endorsements because of it. Jury awarded him a ludicrous amount of money. The judge subsequently tossed out the jury verdict, and the appeals court just supported the judge. Mark believes this to be a Good Thing and a triumph for the First Amendment. Mark, of course, has this luxury. He, after all, wasn't portrayed as a member of the Ku Klux Klan, as I was in an issue of SPAWN. To me, it was never a First Amendment issue. It was a "Todd's being a jerk" issue. Yes, the First Amendment defends Todd's right to be a jerk, but not at someone else's monetary expense. The courts felt "no reasonable person" could confuse Twist with the comic book character. Oddly, to my mind, no reasonable person could confuse a soap opera actress with her character, yet actresses portraying bad girls get slapped in public by irate soap fans. No reasonable person could think "Harry Potter" can lead a child to witchcraft, yet the book is banned from some school systems and libraries. No reasonable person could find OJ Simpson innocent, yet he's out playing golf. No reasonable person could think that a comic book store selling adult comics to adults presents a danger to the town, yet stores are shuttered, store managers arrested and lives disrupted.

PHOENIX - A $15 million jury award against "Spawn" creator Todd McFarlane has pushed his comic-book business into bankruptcy court.
Todd McFarlane Productions Inc. of suburban Tempe filed for Chapter 11 protection from creditors Friday in U.S. Bankruptcy Court.
A jury in St. Louis awarded former NHL player Tony Twist $15 million after concluding that McFarlane and his company profited by using Twist's name without permission and that Twist's publicity rights were infringed.
McFarlane gave the name Antonio "Tony Twist" Twistelli to a New York mob boss character in his "Spawn" comic books in the early 1990s.
The U.S. Supreme Court (news - web sites) in January rejected without comment an appeal by McFarlane arguing that his work was free speech.
Last year, he said his McFarlane Cos., then an umbrella of seven businesses, had annual sales exceeding $50 million.
The bankruptcy filing allows McFarlane's company to continue to operate and reorganize its finances while freeing it from the threat of creditors' lawsuits.
