Former NHL Player Wins $24.5 Million in Misappropriation Suit Tony Twist claimed use of name in comic book required compensation St. Louis, Missouri, July 11, 2000 Former St. Louis Blues enforcer Tony Twist was awarded a whopping $24.5 million in his lawsuit against a comic book creator over the use of his name. The ruling came in Twist’s lawsuit prompted by Todd McFarlane’s creation of a character named "Twist" in the comic book "Spawn" and an animated series on HBO. In Spawn, "Twist," also known as "Antonio Twistelli," is a vile, vulgar mobster who was also known as Don Dracula. Twist, who has been out of the game since last June and is recovering from injuries suffered in a motorcycle wreck last August, testified that the character reduces his opportunities to endorse products and harms his aspirations for a post-hockey career of public speaking and sports broadcasting. Sports fans may remember McFarlane as the man who paid over $3 million for the baseball mark McGwire hit for his record 70th home run two years ago. In a published response to a fan’s letter, McFarlane had acknowledged that the "Twist" character was named after a player on the Quebec Nordiques, Tony Twist’s former team. According to the St. Louis Post-Dispatch, when asked by Twist’s lawyer at trial if he knew of Twist when he named the character, McFarlane stated that "he may have come across it in the sports pages." McFarlane testified that had he wanted to give a character name recognition, he would have picked a name other than Tony Twist’s. McFarlane told a St. Louis Circuit Court jury he would have come up with something such as "Wayneatelli Gretzkytello." McFarlane did acknowledge that he attaches the names of friends and others to his characters but insisted that he never bases his characters’ personas on real people.

LOUIS (AP) - Tony Twist, a former National Hockey League enforcer known more for his fighting than his skating, has been awarded $15 million by a jury that found a comic strip creator had profited by using Twist’s name without his permission. Comic book artist Todd McFarlane is the former principal artist and writer of Spider-Man comics. McFarlane had claimed his use of the name was protected under the First Amendment. Twist disagreed, saying McFarlane had gone outside the bounds of free speech rights. Twist was awarded more than $24.5 million in 2000 by a St. Louis Circuit Court jury, but the judge overruled that decision. The high court rejected the appeal in January without comment.
