Todd McFarlane's Publishing Company Files For Chapter 11 Bankruptcy
In case you missed it, Todd McFarlane Productions filed for bankruptcy (the reorganizing kind) in Arizona on Friday, setting off a bevy of wire stories and the usual comics-realm appropriation of same for rehashing, hit-generating discussion, and general tut-tutting. It's actually a fairly simple story right now, and I think the better one will come a bit later. Until then, this only slightly laborious rundown should suffice:
Because the list of creditors includes a $15 million amount owed to former hockey player Tony Twist and another Todd McFarlane company, McFarlane Toys, most believe that this move is intended to manage the Twist liability (and potentially others). The Twist/McFarlane saga, of which this would then be a significant chapter, is a pretty straightforward legal back and forth. I never liked Spawn... at all. I thought it was an ok comic book at best, but the movie and tv show just sucked huge eggs. However, I've always liked Todd McFarlane . Every interview I've ever seen him in he's impressed me. He genuinely seems like a decent guy and I like his approach to his art. The fact that he's a hockey fan has always appealed to me too. But these are dark days for Mr. McFarlane. According to Hollywood North , McFarlane is now being forced into bankruptcy: A jury in St. Louis awarded former NHL player Tony Twist $15 million after concluding that McFarlane and his company profited by using Twist's name without permission and that Twist's publicity rights were infringed. McFarlane gave the name 'Antonio "Tony Twist" Twistelli' to a New York-based crime character in his Spawn comic books in the early 1990s. The U.S. Supreme Court in January rejected without comment an appeal by McFarlane arguing that his work was free speech. Last year, he said his McFarlane Cos., then an umbrella of seven businesses, had annual sales exceeding $50 million. Ouch! $15 million for some guy using your name in a comic book? Isn't that a little harsh? A girl I know gets hit by a drunk driver (Anyone who drink and drives should be castrated as far as I'm concerned... first offence) and she gets like $80,000. But use a person's name in a comic book and you get $15 million?!?!! What a screwed up world we live in.

    Last issue I talked in detail about the "transformative" test the California Supreme Court applied to the use of celebrity names and likenesses. The Missouri Supreme Court, however, has its own ideas on the subject, as reported by Lisa Dorfman in the always informative Legal Watch column of the Authors Guild Bulletin , in its Winter 2004 issue. Todd McFarlane (who is not having a good legal year - further details no doubt in an upcoming issue's Legal Watch) placed a resurrected CIA assassin as the title character in his comic book Spawn. The hero had been killed by a violent Mafioso by the name of Anthony "Tony Twist" Twistelli. This caught the attention of retired St. Louis Blues hockey player Anthony "Tony" Twist. He and his attorneys also made note of the line of hockey paraphernalia that avowed fan McFarland marketed bearing the Spawn logo. Several court battles later, Dorfman wrote, "The Missouri Supreme Court did reverse the trial court, focusing on the commercial advantage sought by the defendants in using Twist's name. The court held that Twist had demonstrated an intent on the part of the author to create the impression that Twist was 'somehow associated with' the book, including the marketing of the work to hockey fans…"

    My Great Gram died.
    She was a firebox of a lady, stuffed with bright magic and tales of the old country. I remember how she would always take my face in her tiny hands whenever she greeted me. Sometimes they would shake, but I never thought they rocked from age. I just thought they were filled with electrical energy. She had this invisible ignition switch that flipped on the second she saw the people she loved.
    I doubt I’ll live to be 98, but if I do, I hope I have that same spark when I go. I’ll miss you, Gram... Sorry for the short column, amigos. Early Retirement Planetary writer Warren Ellis has taken issue with various news sites who ran headlines announcing his retirement from comics (not SBC, kids). Tony Twist played in the National Hockey League for nine years. During his career, he was known as an enforcer for his aggressive tactics on the ice. Off the ice, he appeared on radio and television and became involved with charities. Todd McFarlane, an avowed hockey fan, created the comic book Spawn and added to the story line the character of a Mafia Don named Anthony Twistelli, known as Tony Twist. McFarlane acknowledged that his character was based on Tony Twist, the hockey player. Twist filed suit against McFarlane for misappropriation of his name. The jury awarded Twist $24.5 million dollars, but the trial court granted McFarlane's motion for judgment notwithstanding the verdict. The Supreme Court of Missouri, however, reversed and remanded for a new trial in John Doe a/k/a Tony Twist v. TCI Cablevision, et al , No. SC84856 (Mo. banc 2003). Spawn story line created an unmistakable correlation between Twist the hockey player and Twist the Mafia Don. Twist presented sufficient evidence to prove that his name was used as a symbol of his identity. Twist also presented sufficient evidence to establish the intent to gain a commercial advantage by using his name to attract consumer attention to Spawn comic books.

After ten non-descript seasons, he left the game in 1999. Even the most ardent hockey fan would have a hard time picking him out of a lineup. In his best season he scored three goals. He finished his career with ten.He was just another drone who drifted in and out of the system without ever making a real mark. McFarlane creates a fictional comic book character who shares a name with a nobody from St. Louis. At the time the character is created, the St. Louis nobody has a hard time being recognized by members of his own family. A few years later, Mr. Nobody becomes a low-watt star, barely known in his own town and completely invisible to most of the nation. The character created by McFarlane is part of an empire that reaches world-wide. For every one person who has heard of Tony Twist the hockey player, there are a thousand who know Tony Twist the Spawn villain. And the courts give millions to the hockey guy? McFarlane should sue the hockey player for degrading the worth of his character by being such a complete whiner.
