Rick Stewart/Allsport ST. LOUIS (AP) A St. Louis circuit judge has overturned a jury verdict awarding former St. Louis Blues enforcer Tony Twist $24.5 million for the unauthorized use of his name. In July, following a two-week trial, a jury found that artist Todd McFarlane based a character in his "Spawn" comic book series on Twist. The character, "Antonio Twistelli," is a vile, vulgar mobster. The real Twist said he never consented to McFarlane's use of his name. Tuesday, St. Louis Circuit Judge Robert H. Dierker Jr. ruled the jury's verdict came "against the manifest weight of the evidence."

In the real world of professional hockey, one of the tough guys is a former right-winger by the name of Anthony R. Twist. He too is known as "Tony Twist." The two characters have nothing in common except their name, but that identity has triggered a potentially significant lawsuit. The real Tony Twist sued Todd McFarlane, creator of the fictional Tony Twist, in the civil courts of Missouri. Last July, Twist walked out of the state's Supreme Court with a judgment of $24.5 million. Now the parties are in the U.S. Supreme Court on McFarlane's petition for review. Those of us who write for a living will be watching with understandable concern.

Headline in the St. Louis Post-Dispatch Tony Twist wins $15 million verdict . The story goes like this:
    Tony Twist, the former rock 'em-sock 'em Blues hockey player, was awarded $15 million Friday by a jury that concluded comic book artist Todd McFarlane had profited by using Twist's name without his permission.
    McFarlane, formerly the principal artist and writer of Spiderman comics, gave the name Tony Twist to a violent New York mob boss in McFarlane's Spawn comics in the early 1990s.
    In a case that could have broad meaning for artistic freedom, McFarlane insisted the name had literary value and his use of it was protected under the First Amendment, but Twist contended McFarlane had exceeded free speech rights.
    It was the second time for Twist's claims to go to trial. A St. Louis Circuit Court jury ruled in Twist's favor in 2000 and awarded him $24.5 million, but the trial judge overruled the verdict and the state appeals court later ruled in McFarlane's favor citing his free speech rights. The Missouri Supreme Court, however, last year ordered a new trial after concluding that McFarlane's use of Twist's name was driven more by moneymaking than by "artistic value."
    "They made Tony into a Mafia boss," said James Holloran, an attorney for Twist. "He was involved in murders and kidnappings and rapes."

Twist and Walker, both former NHLers will take part in a hockey-themed fighting tournament called The Battle of the Hockey Gladiators next year.
"More players will be announced in the near future," Promoter Darryl Wolski said. "This thing has taken on a life of its own."
Wolski said 64 men will be selected from an anticipated pile of entries. Players will be dressed in hockey uniforms and punch it out on ice in a tournament next year during Labor Day weekend. The last gladiator standing will pocket $50,000. The Manitoba promoter had received more than 20 applications by Thursday afternoon. There is a $250 entry fee.
"The only people we're going to accept are people who have played or are playing hockey," Wolski said. "We won't take street thugs."

By then, Gino had got a reputation as a fighter that loved to fight for his teammates. It may sound strange that an Indian plays hockey, but there are actually many of today’s NHL-stars that descends from the old Native American tribes.

    Why Doesn't My Dad Like Hockey?

    I keep asking myself this question. How come? Dad seems like the perfect raw material for a hockey fan. Blue collar background. Well, not really.
    He grew up on a farm during the Depression, in a hardscrabble Midwest landscape where coal mining was the largest employer. His parents' farm was so far removed from the nearest town that they had to refer to themselves as "Horse Crikkers" for anyone to recognize their farming township.
    Dad didn't drive a tractor, much less a zamboni, when he worked in the family fields as a boy. He walked barefoot behind horses and mules to plow the corn rows. Dad grew up to be a used car salesman, the a successful sales manager for a Chevy dealership, and at the end of his career he owned his own used car lot.
